2010-2011 Minimum Salary Schedule

State Minimum Salary Schedule for Classroom Teachers, Full-Time Librarians, Full-Time Counselors, and Full-Time Nurses (RN) (Section 21.402(c), Texas Education Code)

The state minimum salary schedule is calculated in accordance with the provisions of TEC 21.402(a) and applies only to classroom teachers, full-time librarians, full-time counselors and full-time nurses (RN). In no instance may a school district pay classroom teachers, full-time librarians, full-time counselors or full-time nurses (RN) less than the state base salary listed for that individual's years of experience.

Section 21.401 of the Texas Education Code specifies that an educator employed under a 10-month contract must provide a minimum of 187 days of service.

The 2010-2011 salary schedule does not include the salary increase established by section 21.402 (c-1) as added by the 2009, 81st (R) Legislative Session, (See, Attorney General’s Opinion GA-0641). If the district adopted a local salary schedule in 2008-2009 school year, each eligible individual must be paid, at a minimum, the amount that individual would have received on the 2008-2009 local salary schedule, pursuant to 19 TAC, 153.1021. This includes any local supplement, any money representing a career ladder supplement in 2010-2011, plus the pay raise that was mandated by HB3646 for 2009-2010 school year. (See, Attorney General’s Opinion GA-0785).

Also, Attorney General’s Opinion GA-0785 requires school districts, that adopted a salary schedule during the 2008-2009 school year, to pay eligible new hires during the 2009-2010 and 2010-2011 school years, pursuant to 19 TAC, 153.1021, the amount adopted by the district’s 2008-2009 salary schedule as if that schedule was in effect during the 2009-10 and 2010-2011 school years.

Full-time speech pathologists were not placed on the state mandated minimum salary schedule. However, for the 2009-2010 school year, full-time speech pathologists are required to receive the mandated pay raise under HB 3646, above what a full-time speech pathologist would have been paid on the district's 2008-2009 salary schedule. If a school district adopted a local salary schedule during the 2008-2009 school year that included full-time speech pathologists, the 2008-2009 “plus steps” requirement applies also applies to the 2009-2010 and 2010-2011 school years.

For the purpose of determining the uniform monthly amount, the product of $60 multiplied by the number of WADA should be reduced by related social security coverage costs and by related payments made by the district under Section 825.405, Government Code.
