Hearings and Appeals Process

 

Appeals to the Commissioner of Education for teacher employment, nonrenewals, terminations, and suspensions without pay are governed by TEC Section 21.301.

General Appeals refer to Section 7.057 of the Texas Education Code (TEC) and Chapter 157 of the TEA Rules, Texas Administrative Code (TAC). 

Motion for Rehearing refer to Section 2001.145 of the Government Code for more information. 

Judicial Appeals refer to Section 2001.171 of the Government Code for more information.

For the filing procedures refer to Subchapter AA. General Provisions for Hearings Before the Commissioner of Education Section 157.1049.

Amendments to the 19 TAC Chapter 157, Subchapters AA-DD

The Commissioner has adopted amendments to subchapters AA, BB, and CC of 19 Texas Administrative Code, Chapter 157, Hearings and Appeals, that include clarifying the requirements for motions requiring a certificate of conference, clarifying hearings procedures regarding federal programs and updating federal statutory references, and adding procedures regarding the issuance of subpoenas and depositions.

Teacher Termination, Non-Renewal or Suspension Without Pay

Appeals to the Commissioner of Education for teacher employment, nonrenewals, terminations, and suspensions without pay are governed by TEC Section 21.301

Hearings before a Hearing Examiner refer to TEC Sections 21.251 and 21.253 Request for a Hearing.

Judicial appeals refer to Section 21.307 of the TEC for information.
