FAQs-Preliminary Criminal History Evaluation of Educator Certification Candidates

 

What is a “Request for Preliminary Criminal History Evaluation”?

A Request for Preliminary Criminal History Evaluation is a non-mandatory, non-binding evaluation of an individual’s self-reported criminal history, by the agency’s educator investigations staff.  The evaluation is a service provided to the requestor for a non-refundable fee.  The requestor will receive a preliminary criminal history evaluation letter by email from the agency advising the requestor of a determination of potential ineligibility for educator certification.  The evaluation is based solely on the information that is provided by the requestor. 

 

Who can request a Preliminary Criminal History Evaluation?

    1. Are you enrolled or planning to enroll in an educator preparation program?  

    2. Are you planning to take a certification exam for initial educator certification?

    3. Do you have reason to believe that you are or may be ineligible for educator certification due to a conviction or deferred adjudication for a felony or misdemeanor offense?

If you answered no to both questions 1. and 2. above you are not eligible for a preliminary evaluation of your criminal history.  If you answered yes to at least one of the two questions you are eligible for a preliminary evaluation of your criminal history as long as you answered yes to question 3.  If you answered no to question 3. you are not eligible for a preliminary evaluation of your criminal history regardless of your answers to questions 1 and 2.


What is the fee for a Preliminary Criminal History Evaluation?

The fee is $150.00.  THE FEE IS NON-REFUNDABLE.  You must use a credit card to pay the fee. 

 

How do I request a Preliminary Criminal History Evaluation?

    1.Provide payment through Texas Online

    2. Complete the Request for Preliminary Criminal History Evaluation of Educator Certification Candidates and follow the instructions provided. 

    3. Submit application and all required documentation to Texas Education Agency by certified mail or fax.

    4. Once all required documentation and the fee are received, Texas Education Agency, Office of Investigations will evaluate your criminal history.  A criminal history letter will

        be sent via Email that will provide you with the Agency’s opinion as to your eligibility for educator certification based on the information you have provided.

 

When will this service be made available?

November 1, 2010

Will I still be required to be fingerprinted when I apply for certification?

Yes.  Participation in the evaluation will not preclude you from being required to submit to a national criminal history review at the time you apply for your educator certification.  This means you will be required to be fingerprinted and to pay the applicable fees at that time.  Your criminal history will be reviewed at that time and you may be subject to an investigation based on that criminal history, including any relevant information regarding the criminal history evaluated that you failed to submit for evaluation.
