Special Education Rules and Regulations Side-by-Side

The purpose of the "side-by-side" is to assist educators, parents, and other stakeholders to better understand the federal regulations (Individuals with Disabilities Education Act), State Law (Texas Education Code), and State Rules (Texas Administrative Code: Commissioner's and State Board of Education Rules concerning Special Education). 

Federal Regulations - Individuals with Disabilities Education Act (IDEA) 2004

State Rules (Not required by IDEA or federal regulations)


States must identify any rule, regulation, or policy that is State-imposed (not required by IDEA or Federal regulations) as part of its annual state application to receive federal funding.

Commissioner's Rules


Special education related commissioner's rules can be found in the Texas Administrative Code (TAC) Title 19, Chapter 89. Adaptations for Special Populations, Subchapter AA: Commissioner's Rules Concerning Special Education Services.
