February 2013 Summary of Commissioner Rule Actions

 

1. Adopted New 19 TAC Chapter 70, Technology-Based Instruction, Subchapter AA, Commissioner's Rules Concerning the Texas Virtual School Network (TxVSN)

Effective Date: February 27, 2013.

New 19 TAC Chapter 70, Technology-Based Instruction, Subchapter AA, Commissioner's Rules Concerning the Texas Virtual School Network (TxVSN), was filed as adopted with the Texas Register under the commissioner's rulemaking authority on February 7, 2013.

The adopted new rules provide guidance for school districts, charter schools, and other entities participating in the TxVSN, in accordance with the Texas Education Code, Chapter 30A. The new rules were adopted with and without changes from what was published as proposed.

2. Adopted Revisions to 19 TAC Chapter 101, Assessment, Subchapter CC, Commissioner's Rules Concerning Implementation of the Academic Content Areas Testing Program, Division 1, Implementation of Assessment Instruments

Effective Date: March 14, 2013.

Revised 19 TAC Chapter 101, Assessment, Subchapter CC, Commissioner's Rules Concerning Implementation of the Academic Content Areas Testing Program, Division 1, Implementation of Assessment Instruments, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on February 22, 2013. 

The adopted amendment to §101.3011 clarifies legislatively required changes to the state assessment program with the implementation of the State of Texas Assessments of Academic Readiness (STAAR) program. Additionally, the adopted amendment to §101.3011 defers the implementation of the 15% course grade requirement specified in the Texas Education Code, §39.023(c), from the 2012-2013 school year to the 2013-2014 school year. Adopted new §§101.3012-101.3016 reflect changes to 19 TAC Chapter 101, Assessment, due to statute granting rulemaking authority over the assessment program to the commissioner of education by the Texas Legislature as necessary. The revisions were adopted without changes from what was published as proposed.
