Proposed Amendment to 19 TAC Chapter 101, Assessment, Subchapter B, Development and Administration of Tests, §101.23, Performance Standards
(Second Reading and Final Adoption)
This item presents for second reading and final adoption proposed amendment to 19 TAC Chapter 101, Assessment, Subchapter B, Development and Administration of Tests, §101.23, Performance Standards. Texas Education Code (TEC), §39.024(a), authorizes the State Board of Education (SBOE) to set the standard of satisfactory performance on the Texas Assessment of Knowledge and Skills (TAKS). The proposed amendment would set new performance standards as appropriate for the reading and mathematics assessments in Grades 3-8 based on the implementation of a vertical scale. No additional changes are recommended since approved for first reading. Statutory authority for this action is TEC, §39.024 and §39.036.

Adoption of the Review of 19 TAC Chapter 30, Administration, Subchapter A, State Board of Education: General Provisions, and Proposed Amendment to 19 TAC §30.1, Petition for Adoption of Rule Changes

(First Reading and Filing Authorization of Amendment)
Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board of Education (SBOE) rules. This item presents the adoption of the review of 19 TAC Chapter 30, Administration, Subchapter A, State Board of Education: General Provisions. The rule being reviewed establishes the SBOE process for petitioning the adoption of changes to SBOE rules, as required by Texas Government Code, §2001.021. This item also presents the proposed amendment to 19 TAC §30.1, Petition for Adoption of Rule Changes, that would adopt the petition form in rule. Approval of 2009-2013 Rule Review Plan for State Board of Education RulesThis item provides an opportunity for the State Board of Education (SBOE) to approve a rule review plan for SBOE rules during the period of September 2009 through August 2013. Texas Government Code, §2001.039, codifies a rule review of existing state agency rules, including SBOE rules. The rule review requirement in §2001.039 is designed to ensure that the reason for initially adopting a rule continues to exist. There are no changes to the proposed rule review plan since it was presented for discussion in November 2008. Statutory authority for this action is Texas Government Code, §2001.039.

Proposed Amendments to 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter B, Middle School, and Subchapter C, High School
(Second Reading and Final Adoption)
The Texas Essential Knowledge and Skills (TEKS) for mathematics were revised and amended to be effective August 1, 2006. House Bill 1, passed by the 79th Texas Legislature, Third Called Session, 2006, requires the development of college readiness standards and the incorporation of approved college readiness standards into the essential knowledge and skills. This item presents for second reading and final adoption proposed amendments to 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter B, Middle School, and Subchapter C, High School, that would incorporate approved college readiness standards into the mathematics TEKS. No additional changes are recommended since approved for first reading. Statutory authority for this action is Texas Education Code (TEC), §§7.102(c)(4), 28.002, 28.008, and 28.025.

Proposed Revisions to 19 TAC Chapter 112, Texas Essential Knowledge and Skills for Science, Subchapter A, Elementary, Subchapter B, Middle School, and Subchapter C, High School

This item presents for first reading and filing authorization proposed revisions to 19 TAC Chapter 112, Texas Essential Knowledge and Skills for Science, Subchapter A, Elementary, Subchapter B, Middle School, and Subchapter C, High School. The proposed revisions recommend an implementation date of the 2010-2011 school year for the revised science Texas Essential Knowledge and Skills (TEKS). Midcycle 2010 Proclamation of the State Board of Education Advertising for Bids on Instructional Materials The Midcycle 2010 Proclamation advertises for bids on instructional materials to be available to school districts and open-enrollment charter schools beginning in the school year 2010-2011. The proposed proclamation contains links to the current Texas Essential Knowledge and Skills (TEKS) in each subject for which bids are being invited, an average cost to the state for adopted instructional materials in each subject for which bids are being invited, specifications for providing computerized files to produce Braille versions of adopted instructional materials, and a schedule for the Midcycle 2010 adoption. The following subjects, for both elementary and secondary grades, are proposed for inclusion in the Midcycle 2010 Proclamation: Mathematics, Technology Applications, Languages Other Than English, Health, Physical Education, and Fine Arts. Recommendations Regarding Readoption of Instructional Materials
This item recommends readoption of instructional materials with contracts that expire on August 31, 2009. This action is recommended to ensure that these materials remain available for distribution to school districts until new replacements become available. 12.
Consideration of Options for Graduation Credit for Athletics
As the result of a petition submitted to the State Board of Education (SBOE) requesting that athletics for one to four credits be added to the list of allowable elective credits for graduation, the SBOE took action to approve the petition and initiate the rulemaking process. During the May 2008 meeting the Committee on Instruction directed staff to seek input from administrators throughout the state regarding the proposed amendment and to present the item at the July 2008 Committee of the Full Board meeting for further discussion. At the July 2008 meeting, agency staff presented the results of the survey to the SBOE. The SBOE considered this item at the November 2008 meeting and voted to postpone the item until January 2009. Approval of Nominees to Recommend to the Governor for Service on the Board of Trustees of the Teacher Retirement System of Texas The board of trustees of the Teacher Retirement System of Texas (TRS) is comprised of nine members. Two of the members are appointed by the governor, subject to confirmation by two-thirds of the senate, from lists of nominees submitted by the State Board of Education (SBOE). Due to the resignation of James H. Lee, this item provides an opportunity for the SBOE to approve a list of nominees for an appointment to the board of trustees of the TRS to be transmitted to the governor. The term of office of the governor's appointee will expire on August 31, 2013. The list of nominations from SBOE members for the board of trustees of the TRS will be distributed at the meeting. Discussion of Pending Litigation
The State Board of Education will enter executive session in accordance with the Texas Government Code, §551.071(1)(A), to discuss pending litigation with the general counsel, legal staff, and if necessary, attorney(s) from the Attorney General's Office as listed in the agenda. The Committee of the Full Board will meet in Room 1-103 to discuss this item.
