 Proposed Repeal of Career and Technical Education Texas Essential Knowledge and
Skills in 19 TAC Chapters 119-125 and Proposed Revisions to
19 TAC Chapter 127, Texas Essential Knowledge and Skills for Career Development
(Second Reading and Final Adoption)

SUMMARY:
This item presents for second reading and final adoption the proposed repeal of 19 TAC Chapter 119, Texas Essential Knowledge and Skills for Agricultural Science and Technology Education; Chapter 120, Texas Essential Knowledge and Skills for Business Education; Chapter 121, Texas Essential Knowledge and Skills for Health Science Technology Education; Chapter 122, Texas Essential Knowledge and Skills for Home Economics Education; Chapter 123, Texas Essential Knowledge and Skills for Technology Education/Industrial Technology Education; Chapter 124, Texas Essential Knowledge and Skills for Marketing Education; and Chapter 125, Texas Essential Knowledge and Skills for Trade and Industrial Education. The proposed repeal would remove the Texas Essential Knowledge and Skills (TEKS) adopted to be effective in 1998 for high school Career and Technical Education courses that will be superseded by 19 TAC Chapter 130, beginning with the 2010-2011 school year. This item also presents for second reading and final adoption proposed revisions to 19 TAC Chapter 127, Texas Essential Knowledge and Skills for Career Development. The proposed revisions to 19 TAC Chapter 127 would repeal the TEKS adopted to be effective in 1998 for Career Investigation in 19 TAC §127.2 and Career Connections in 19 TAC §127.12 that will be superseded by 19 TAC §127.3 and §127.4 and §§127.13-127.15 of this chapter beginning with the 2010-2011 school year. The proposed revisions would also remove references in 19 TAC §127.1 and §127.11 to rules that would be repealed. No additional changes are recommended since approved for first reading.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, 28.0022, and 28.025.

EFFECTIVE DATE: The proposed effective date of the proposed rule actions is 20 days after filing as adopted with the Texas Register. Under TEC, §7.102(f), the State Board of Education (SBOE) must approve the rule actions at second reading and final adoption by a vote of two-thirds of its members to specify an effective date earlier than the beginning of the 2011-2012 school year. The earlier effective date will immediately repeal rules that have been superseded, as well as amend existing rules referencing the repealed rules, to avoid confusion.

PREVIOUS BOARD ACTION: The SBOE adopted the TEKS for career and technology education and for career development to be effective September 1, 1998. In July 2009, proposed new 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, was adopted to be effective August 23, 2010. Also in July 2009, proposed revisions to 19 TAC Chapter 127, Texas Essential Knowledge and Skills for Career Development, Subchapter A, Middle School, and Subchapter B, High School, were adopted to be effective September 1, 2009. The July 2009 rule actions for 19 TAC Chapter 130 and Chapter 127 were adopted with an implementation date of the 2010-2011 school year. The proposed repeal of 19 TAC Chapters 119-125 and revisions to 19 TAC Chapter 127 were approved for first reading and filing authorization at the May 2010 SBOE meeting.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: In July 2009, the SBOE adopted proposed revisions to the TEKS for high school Career and Technical Education (CTE) courses and middle and high school career development courses with an implementation date of the 2010-2011 school year. These revisions will supersede the original TEKS at the time of implementation. With the implementation of the new TEKS for high school CTE courses and middle and high school career development courses in the 2010-2011 school year, the original TEKS are no longer needed and may now be repealed. Existing rules must also be amended to remove references to rules that would be repealed.

No additional changes are recommended since approved for first reading.

FISCAL IMPACT: The Texas Education Agency has determined that there are no additional costs to persons or entities required to comply with the proposed rule actions. In addition, there is no direct adverse economic impact for small businesses or microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.

PUBLIC AND STUDENT BENEFIT: Benefits include better alignment of the TEKS and coordination of the standards with the adoption of instructional materials.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed rule actions would have no new procedural and reporting implications.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed rule actions would have no new locally maintained paperwork requirements.

PUBLIC COMMENTS: Following the May 2010 SBOE meeting, notice of the proposed repeal of Career and Technical Education Texas Essential Knowledge and Skills in 19 TAC Chapters 119-125 and proposed revisions to 19 TAC Chapter 127, Texas Essential Knowledge and Skills for Career Development, was filed with the Texas Register initiating the official public comment period. No comments had been received at the time this item was prepared. A summary of any public comments received and corresponding agency responses regarding the proposal will be provided to the SBOE during the July 2010 meeting.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES: To reduce the volume of the agenda and the cost of printing, the text of the proposed repeal of Career and Technical Education TEKS in 19 TAC Chapters 119-125 is not presented in this agenda. COMMISSIONER'S RECOMMENDATION: I recommend that the State Board of Education:

By an affirmative vote of two-thirds of the members of the board, approve for second reading and final adoption the proposed repeal of Career and Technical Education Texas Essential Knowledge and Skills in 19 TAC Chapters 119-125 and proposed revisions to 19 TAC Chapter 127, Texas Essential Knowledge and Skills for Career Development, with an effective date of 20 days after filing as adopted with the Texas Register
