1. Discussion of Parliamentary Procedures

2. Commissioner's Comments Regarding the SBOE Agenda

This item provides an opportunity for the board to be briefed on current agenda items and related activities at the Texas Education Agency.

3. Public Hearing Regarding Instructional Materials Submitted for Adoption by the State Board of Education Under Proclamation 2011

A public hearing before the State Board of Education (SBOE) is scheduled for Thursday, September 23, 2010, in the William B. Travis Building, Room 1-104. Testimony will be presented regarding instructional materials submitted for adoption under Proclamation 2011. Texas residents who have registered to speak on this agenda item will be given priority over non-Texas residents. Oral testimony will be limited to three minutes, and speakers are asked to provide 30 copies of their testimony for distribution. Representatives of publishing companies will be allowed to provide oral responses to testimony at the hearing. Publishers will also have the opportunity to file written responses following the hearing. These instructional materials were reviewed by the state review panels in June of 2010. Statutory authority is 19 Texas Administrative Code (TAC) §66.60(b) and Texas Education Code (TEC), §28.002.

4. Proposal Options for Supplemental Science Instructional Materials

The request for Supplemental Science instructional materials was issued by the State Board of Education (SBOE) in May 2010. Sample materials bid under Supplemental Science are due in the regional education service centers and in the Texas Education Agency in spring 2011. On July 21, 2010, staff presented the Supplemental Science Question and Answer document for approval. Statutory authority for this action is Texas Education Code (TEC), §31.035.

5. Discussion of Proposed Cycle for the Adoption of Instructional Materials

The Texas Education Code (TEC), Chapter 31, requires the State Board of Education (SBOE) to adopt a review and adoption cycle for textbooks for elementary grade levels, including prekindergarten, and secondary grade levels for each subject in the required curriculum. At the conclusion of the 80th Texas legislative session it was requested that the agency explore options to reduce the purchase cost of adopted instructional materials. This item will provide the board an opportunity to discuss the review and adoption cycle in light of the budgetary constraints that are projected for the 82nd Texas legislative session. Statutory authority is Texas Education Code (TEC), §31.022.

6. Update on Technology Applications Texas Essential Knowledge and Skills (TEKS) Review

This item provides the opportunity for staff to present an update on the review of the technology applications Texas Essential Knowledge and Skills (TEKS) and for the board to hear invited testimony from appointed expert reviewers and representatives from TEKS review committees. Statutory authority is Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

7. Consideration of Texas Attorney General Opinion GA-0707 Regarding Transfers from the Permanent School Fund to the Available School Fund and Determination as to Whether Transfers May be Made from the Permanent School Fund to the Available School Fund

This item provides the opportunity for the board to consider Attorney General Opinion No. GA-0707. The board will receive an analysis of the opinion from legal counsel regarding the board’s duties and authority regarding the requirement in Article VII, §5(a)(2) that the total amount distributed over ten years cannot exceed the total return on all investment assets of the PSF over the same ten-year period. The board will determine whether transfers may be made from the Permanent School Fund to the Available School Fund in FY2011 and whether a catch up payment may be made for FY 2010. Statutory authority for this action is the Texas Constitution, Article VII, §5.

8. Decision on the Percentage Distribution of the Permanent School Fund

This item provides an opportunity for the committee and board to evaluate and determine the percentage distribution of the Permanent School Fund for the fiscal years beginning September 1, 2012 and September 1, 2013. Statutory authority for this action is the Texas Constitution, Article VII, §5.

9. Education on the Real Return Asset Class

This item provides an opportunity for the committee to receive a presentation on the real return asset class including implementation alternatives.

10. Discussion of Pending Litigation

The State Board of Education will enter executive session in accordance with the Texas Government Code, §551.071(1)(A), to discuss pending litigation with the general counsel, legal staff, and if necessary, attorney(s) from the Attorney General's Office. The Committee of the Full Board will meet in Room 1-103 to discuss any litigation arising after the date of posting.
