September 2010 Summary of State Board for Educator Certification Rule Actions

 

1. Adopted New 19 TAC Chapter 227, Provisions for Educator Preparation Candidates, Subchapter B, Preliminary Evaluation of Certification Eligibility (PDF)

Effective Date: October 28, 2010.

New 19 TAC Chapter 227, Provisions for Educator Preparation Candidates, Subchapter B, Preliminary Evaluation of Certification Eligibility, was filed as adopted with the Texas Register on October 8, 2010.

House Bill (HB) 963, 81st Texas Legislature, 2009, requires state licensing agencies to adopt rules necessary to administer requests for preliminary criminal history evaluations. The adopted new subchapter provides procedures that allow for administering and responding to requests for preliminary criminal history evaluations. New 19 TAC Chapter 227, Provisions for Educator Preparation Candidates, Subchapter B, Preliminary Evaluation of Certification Eligibility, was adopted with no changes from what was published as proposed.

2. Adopted Amendment to 19 TAC Chapter 230, Professional Educator Preparation and Certification, Subchapter N, Certificate Issuance Procedures, §230.436, Schedule of Fees for Certification Services (PDF)

Effective Date: October 28, 2010.

Amended 19 TAC Chapter 230, Professional Educator Preparation and Certification, Subchapter N, Certificate Issuance Procedures, §230.436, Schedule of Fees for Certification Services, was filed as adopted with the Texas Register on October 8, 2010.

The adopted amendment provides for a nonrefundable fee for a request for preliminary criminal history evaluation as authorized by House Bill (HB) 963, 81st Texas Legislature, 2009. The amendment to 19 TAC §230.436, Schedule of Fees for Certification Services, was adopted with no changes from what was published as proposed.

Effective Date: October 28, 2010.

Amended 19 TAC Chapter 230, Professional Educator Preparation and Certification, Subchapter N, Certificate Issuance Procedures, §230.437, Issuance of Additional Certificates Based on Examination, and Subchapter P, Requirements for Standard Certificates and Specialized Assignments or Programs, §230.483, Specific Requirements for Standard Career and Technical Education Certificates Based on Experience and Preparation, was filed as adopted with the Texas Register on October 8, 2010.

The adopted amendments allow the Marketing Education: Grades 8-12 certificate to be obtained through certification by examination and address the verification of work experience. The amendments to 19 TAC §230.437, Issuance of Additional Certificates Based on Examination, and §230.483, Specific Requirements for Standard Career and Technical Education Certificates Based on Experience and Preparation, were adopted with no changes from what was published as proposed.

4. Adopted Amendments to 19 TAC Chapter 233, Categories of Classroom Teaching Certificates, §§233.1, General Authority; 233.2, Generalist; 233.3, English Language Arts and Reading; Social Studies; 233.4, Mathematics; Science; 233.12, Career and Technical Education (Certificates not requiring experience and preparation in a skill area); and 233.15, Languages Other Than English (PDF)

Effective Date: October 28, 2010.

Amended 19 TAC Chapter 233, Categories of Classroom Teaching Certificates, §§233.1, General Authority; 233.2, Generalist; 233.3, English Language Arts and Reading; Social Studies; 233.4, Mathematics; Science; 233.12, Career and Technical Education (Certificates not requiring experience and preparation in a skill area); and 233.15, Languages Other Than English, was filed as adopted with the Texas Register on October 8, 2010.

The adopted amendments update the rules to clarify that assignment criteria are specified in 19 TAC §231.1, Criteria for Assignment of Public School Personnel, and remove expired provisions. The adopted amendments also add a new certificate for Speech: Grades 7-12, to be issued no earlier than November 1, 2010; and expand the certificates issued for languages other than English (LOTE) by adding four new certificates for Hindi, Italian, Turkish, and Urdu in Early Childhood-Grade 12, to be issued no earlier than November 1, 2010. The amendments to 19 TAC §233.1, General Authority, and §233.4, Mathematics; Science, were adopted with technical changes in response to requests for clarification by the SBEC. All other amendments were adopted with no changes from what was published as proposed.

5. Adopted Amendment to 19 TAC Chapter 233, Categories of Classroom Teaching Certificates, §233.14, Career and Technical Education (Certificates requiring experience and preparation in a skill area) (PDF)

Effective Date: October 28, 2010.

Adopted Amendment to 19 TAC Chapter 233, Categories of Classroom Teaching Certificates, §233.14, Career and Technical Education (Certificates requiring experience and preparation in a skill area), was filed as adopted with the Texas Register on October 8, 2010.

The adopted amendment provides that the review and approval of work experience can be performed by a certified school administrator in the case of an educator otherwise qualified for certification by examination in Marketing Education: Grades 8-12. The adopted amendment to 19 TAC §233.14, Career and Technical Education (Certificates requiring experience and preparation in a skill area), was adopted with a technical change.

6. Adopted Revisions to 19 TAC Chapter 244, Certificate of Completion of Training for Appraisers (PDF)

Effective Date: October 28, 2010.

Revised 19 TAC Chapter 244, Certificate of Completion of Training for Appraisers, was filed as adopted with the Texas Register on October 8, 2010.

The adopted revisions update the rules to reflect current law regarding the certification of appraisers of educators employed in Texas public schools. The adopted amendment to 19 TAC §244.2, Conditions for Issuing a Certificate of Completion of Training for Appraisers of Teachers, was adopted with changes. All other revisions were adopted with no changes from what was published as proposed.
