3. Legislative Recommendations for the 82nd Texas Legislature
This item provides the committee and the State Board of Education (SBOE) an opportunity to make decisions on legislative recommendations to the 82nd Texas Legislature. Statutory authority for this action is the Texas Education Code (TEC), §7.102(c)(1).
4. Proposed New 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.37, Advanced Quantitative Reasoning (One Credit)
(First Reading and Filing Authorization)
This item presents for first reading and filing authorization proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.37, Advanced Quantitative Reasoning (One Credit). The proposal would add a new mathematics course to satisfy the fourth mathematics graduation requirement. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.
5. Report and Recommendations from the Commissioner of Education Regarding Instructional Materials Offered for Adoption under Proclamation 2011
Proclamation 2011 of the State Board of Education (SBOE) calls for new instructional materials to be used in school districts and open-enrollment charter schools beginning in school year 2011–2012. Proclamation 2011 includes Prekindergarten Systems; English Language Arts, Grades 2–8; Spanish Language Arts, Grades 2–6; English as a Second Language, Grades K–8; Handwriting, Grades 1–3; Spelling, Grades 1–6; Speech, Grades 6–8; and English, I–IV. This item will present the report and recommendations from the commissioner of education that instructional materials offered for adoption be placed on the conforming list, be placed on the nonconforming list, or be rejected. Recommendations will also be made regarding manufacturing standards and specifications, and correction of factual errors to be required in adopted materials. Statutory authority for this action is the Texas Education Code (TEC), §31.023 and §31.024.
6. Update on Bids Submitted for Supplemental Science Instructional Materials
The request for Supplemental Science instructional materials was issued by the State Board of Education (SBOE) in May 2010. On May 21, 2010, staff presented cost models for the board to consider for Supplemental Science instructional materials. On September 24, 2010, the SBOE adopted a new timeline that changed the due date for the Notice of Intent for Bids to October 29, 2010; provide samples of programs for review on February 25, 2011; and amended the question and answer document to reflect the adopted changes. This item will provide an opportunity for the SBOE to discuss a summary of the Notice of Intent for Bids received and consider options as needed. Statutory authority for this action is the Texas Education Code (TEC), §31.035.
7. Decision on the Percentage Distribution of the Permanent School Fund
This item provides an opportunity for the committee and board to evaluate and determine the percentage distribution of the Permanent School Fund for the fiscal years beginning September 1, 2011 and September 1, 2012. Statutory authority for this action is the Texas Constitution, Article VII, §5.

8. Proposed Amendment to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter O, Science, Technology, Engineering, and Mathematics, §130.371, Principles of Technology (One Science Credit)
(Second Reading and Final Adoption)
This item presents for second reading and final adoption proposed amendment to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter O, Science, Technology, Engineering, and Mathematics, §130.371, Principles of Technology (One Science Credit). The proposed amendment would make minor modifications to the Principles of Technology course that would satisfy the physics graduation requirement to align with end-of-course assessment requirements. No additional changes are recommended since approved for first reading. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.
9. Proposed Amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.36, Requirements for Elective Courses on the Bible's Hebrew Scriptures (Old Testament) and New Testament and Their Impact on the History and Literature of Western Civilization
(Second Reading and Final Adoption)
This item presents for second reading and final adoption proposed amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.36, Requirements for Elective Courses on the Bible's Hebrew Scriptures (Old Testament) and New Testament and Their Impact on the History and Literature of Western Civilization. The proposed amendment would update 19 TAC §74.36 to align with revised student expectations in the Texas Essential Knowledge and Skills for Special Topics in Social Studies and Independent Study in English. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.011.
10. Update on Texas Essential Knowledge and Skills (TEKS) Review
This item provides the opportunity for staff to present an update on the review of Texas Essential Knowledge and Skills (TEKS) and for the committee to provide guidance regarding the TEKS review process. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

11. Report on Back-Ordered Instructional Materials and Recommendations for Penalties
Each publisher shall have adopted instructional materials in stock and available for distribution to school districts during the entire adoption period as specified in 19 Texas Administrative Code (TAC) §66.78(b). A back order is defined as adopted instructional material not in stock when ordered and not available for delivery to school districts or open-enrollment charter schools on the specified shipment date. This item presents a report on back-ordered instructional materials and recommends penalties to be assessed for publishers with materials not in stock and available for shipment prior to the first day of school year 2009-2010. Statutory authority for this action is the Texas Education Code (TEC) §31.151 and 19 TAC §66.10(g).
12. Accessible Digital Textbook Files and Materials for Texas Public Schools
This item proposes acceptance of proposals for production of an array of accessible digital textbook files and instructional materials including digital braille files for use with portable braille-reading devices, other accessible student-ready digital files, tactile graphics, and embossed braille textbook copies from the textbooks scheduled to be adopted by the board in November 2010. At the November 2010 meeting, the board is scheduled to consider acceptance of the proposals based on the recommendations of a review panel of experts on accessible instructional materials (AIM). Statutory authority for this action is the Texas Education Code (TEC), §31.028.
13. Production of Large Type Materials for Texas Public Schools
This item proposes acceptance of proposals for production of large type materials from textbooks to be adopted by the board in November 2010. At the November 2010 meeting, the board will consider acceptance of the proposals based on the recommendations of a review panel of Texas teachers of the visually impaired. Statutory authority for this action is the Texas Education Code (TEC), §31.028.
14. Approval of the Selection of a Firm(s) to Provide Absolute Return Discretionary Separately Managed Account Fund-of-Hedge Funds Manager for the Permanent School Fund and Authorization to Negotiate Terms and for Contract Execution by the Commissioner of Education
This item provides an opportunity for the committee and board to review and approve the selection of a firm(s) to provide absolute return discretionary separately managed account fund-of-hedge funds manager for the Permanent School Fund to potentially replace a manager currently on the watch list. Statutory authority for this action is the Texas Constitution, Article VII, §5(f).

15. Proposed Amendments to 19 TAC Chapter 61, School Districts, Subchapter A, Board of Trustees Relationship
(Second Reading and Final Adoption)
This item presents for second reading and final adoption proposed amendments to 19 TAC Chapter 61, School Districts, Subchapter A, Board of Trustees Relationship, §61.1, Continuing Education for School Board Members, and §61.2, Nomination of Trustees for Military Reservation School Districts. The proposed amendments would revise the rules to better align with statute and current practice. No additional changes are recommended since approved for first reading. Statutory authority for this action is the Texas Education Code (TEC), §11.159 and §11.352.
16. Review of Proposed Amendments to 19 TAC Chapter 228, Requirements for Educator Preparation Programs, §§228.2, Definitions; 228.35, Preparation Program Coursework and/or Training; and 228.60, Implementation Date
This item provides the State Board of Education (SBOE) an opportunity to review the State Board for Educator Certification (SBEC) rule actions that would amend 19 TAC Chapter 228, Requirements for Educator Preparation Programs, §§228.2, Definitions; 228.35, Preparation Program Coursework and/or Training; and 228.60, Implementation Date. The proposed amendments would clarify the requirements for educator preparation program coursework, training, internships, student teaching, clinical teaching, practicums, field-based experiences, and field supervision and would provide that the program requirements that were in effect on the date an educator candidate was admitted to a program would be the requirements applicable to that candidate. The statutory authority for the proposed amendments to 19 TAC §§228.2, 228.35, and 228.60 is the Texas Education Code (TEC), §§21.031; 21.044; 21.045(a); 21.050(a) and (c); and 21.051.
17. Review of Proposed Amendments to 19 TAC Chapter 247, Educators' Code of Ethics, and 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases, Subchapter A, General Provisions, §249.3, Definitions
This item provides the State Board of Education (SBOE) an opportunity to review the State Board for Educator Certification (SBEC) rule actions that would amend 19 TAC Chapter 247, Educators' Code of Ethics, and 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases, Subchapter A, General Provisions, §249.3, Definitions. The proposed amendments to 19 TAC Chapter 247 would update the Educators' Code of Ethics to clarify and better address current issues relating to ethical and professional educator conduct. This item also includes a proposed amendment to 19 TAC §249.3 to incorporate technical edits and add definitions for words, terms, and phrases contained in 19 TAC Chapter 247, Educators' Code of Ethics. The statutory authority for the proposed amendments to 19 TAC Chapter 247 and for 19 TAC §249.3 is the Texas Education Code (TEC), §21.041(b)(1), (7), and (8).

5. 2009-2013 Rule Review Plan for State Board of Education Rules
This item outlines the rule review plan for State Board of Education (SBOE) rules during the period of September 2009 through August 2013. Texas Government Code, §2001.039, requires the rule review of existing state agency rules, including SBOE rules. The rule review requirement is designed to ensure that the reason for initially adopting a rule continues to exist.
