SUMMARY:
This item presents for second reading and final adoption proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.37, Advanced Quantitative Reasoning (One Credit).The proposal would add a new mathematics course to satisfy the fourth mathematics graduation requirement. No additional changes are recommended since approved for first reading.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

EFFECTIVE DATE: The proposed effective date of proposed new 19 TAC §111.37 is August 22, 2011.

PREVIOUS BOARD ACTION: At the September 2010 meeting, the Committee on Instruction discussed a proposed mathematics course to satisfy a mathematics graduation requirement. The committee directed staff to prepare an item for first reading and filing authorization. At the November 2010 meeting, proposed new 19 TAC §111.37 was approved for first reading and filing authorization.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: A discussion item regarding proposed new 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, was presented to the Committee of the Full Board during the March 2009 meeting. A request was made to the State Board of Education (SBOE) to add Advanced Mathematical Decision Making, a mathematics course, to the TEKS for CTE. Proposed new 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, including Advanced Mathematical Decision Making, was approved for first reading and filing authorization at the May 2009 meeting. Proposed new 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, as amended, was approved for second reading and final adoption at the July 2009 meeting. The Advanced Mathematical Decision Making course was removed from the proposal by amendment.

At the direction of the board chair, TEA staff convened an independent group of mathematics educators to review standards for a mathematics course that would satisfy the fourth mathematics graduation requirement. The group's recommendations for revisions were presented to the Committee on Instruction at the September 2010 meeting. At that meeting, the committee directed staff to prepare rule text for the November meeting. The SBOE approved the proposed new rule for first reading and filing authorization at the November 2010 meeting.

Attachment II reflects the text of proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.37, Advanced Quantitative Reasoning (One Credit), for consideration by the SBOE for second reading and final adoption. No additional changes are recommended since approved for first reading.

FISCAL IMPACT: There are anticipated fiscal implications for school districts to implement the new course, which may include the need for professional development and revisions to district-developed databases, curriculum, and scope and sequence documents. Since curriculum and instruction decisions are made at the local district level, it is difficult to estimate the fiscal impact on any given district.

There is no direct adverse economic impact for small businesses or microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.

PUBLIC AND STUDENT BENEFIT: Benefits include added flexibility for students in meeting high school graduation requirements.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed new rule would have no new procedural and reporting requirements.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed new rule would have no new locally maintained paperwork requirements.

PUBLIC COMMENTS: Following the November 2010 SBOE meeting, notice of the proposed new 19 TAC §111.37 was filed with the Texas Register initiating the official public comment period. No comments had been received at the time this item was prepared. A summary of any public comments received and corresponding agency responses regarding the proposal will be provided to the SBOE prior to and during the January 2011 meeting.

OTHER COMMENTS AND RELATED ISSUES: None.

COMMISSIONER'S RECOMMENDATION: I recommend that the State Board of Education:

Consider proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.37, Advanced Quantitative Reasoning (One Credit).
