September 2009 Summary of State Board for Educator Certification Rule Actions

 

1. Adopted Amendment to 19 TAC Chapter 232, General Certification Provisions, Subchapter A, Types and Classes of Certificates Issued, §232.4, Probationary Certificates (PDF)

Effective Date: October 25, 2009.

Amended 19 TAC Chapter 232, General Certification Provisions, Subchapter A, Types and Classes of Certificates Issued, §232.4, Probationary Certificates, was filed as adopted with the Texas Register on October 5, 2009.

The adopted amendment removes language that allows the SBEC to grant a waiver of the baccalaureate degree requirement for a probationary certificate that requires such a degree. The adopted amendment also grants an additional year's extension of a probationary certificate to an educator whose contract is terminated, or resigns in lieu of termination, before the end of a school year due to a reduction in force by a school district. The amendment to 19 TAC §232.4, Probationary Certificates, was adopted with no changes from what was published as proposed.

2. Adopted Amendments to 19 TAC Chapter 233, Categories of Classroom Teaching Certificates, §233.1, General Authority, and §233.15, Languages Other Than English (PDF)

Effective Date: October 25, 2009.

Amended 19 TAC Chapter 233, Categories of Classroom Teaching Certificates, §233.1, General Authority, and §233.15, Languages Other Than English, were filed as adopted with the Texas Register on October 5, 2009.

The adopted amendments require an oral proficiency examination for languages other than English (LOTE) certificates. The adopted amendments also expand the certificates issued for LOTE by adding four new certificates for French, German, and Spanish to be issued no earlier than November 1, 2009, and for Latin to be issued no earlier than January 1, 2010. The amendments to 19 TAC §233.1, General Authority, and §233.15, Languages Other Than English, were adopted with no changes from what was published as proposed.

3. Adopted Revisions to 19 TAC Chapter 241, Principal Certificate (PDF)

Effective Date: October 25, 2009.

Revised 19 TAC Chapter 241, Principal Certificate, was filed as adopted with the Texas Register on October 5, 2009.

The adopted revisions update the rules to reflect current law and add specificity to educator preparation and certification requirements relating to the principal certificate. The revisions to 19 TAC §241.20, Requirements for the Issuance of the Standard Principal Certificate, and §241.25, Requirements for the First-Time Principal in Texas, were adopted with changes. House Bill 200, 81st Texas Legislature, 2009, repealed Texas Education Code, §21.054(b), the statutory authority for §241.35, Assessment Process Definition and Approval of Individual Assessments. To comply with Texas Register filing requirements, the repeal of 19 TAC §241.35 will be handled through a separate rulemaking process. All other revisions were adopted with no changes from what was published as proposed.

5. Adopted Amendment to 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases, Subchapter B, Enforcement Actions and Guidelines, §249.14, Complaint, Required Reporting, and Investigation; Investigative Notice; Filing of Petition (PDF)

Effective Date: October 25, 2009.

Amended 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases, Subchapter B, Enforcement Actions and Guidelines, §249.14, Complaint, Required Reporting, and Investigation; Investigative Notice; Filing of Petition, was filed as adopted with the Texas Register on October 5, 2009.

The adopted amendment modifies the description of circumstances requiring a superintendent to report alleged misconduct of an educator who resigns from a school district, the minimum requirements of a superintendent's report, and the requirements for a school district to request that the Texas Education Agency pursue sanctions against an educator who has abandoned his or her contract in violation of the Texas Education Code, §§21.105(c)(2), 21.160(c)(2), or 21.210(c)(2). The amendment to 19 TAC §249.14, Complaint, Required Reporting, and Investigation; Investigative Notice; Filing of Petition, was adopted with no changes from what was published as proposed.
