July 2008 Summary of Commissioner Rule Actions

 

1. Adopted Amendment to 19 TAC Chapter 97, Planning and Accountability, Subchapter AA, Accountability and Performance Monitoring, §97.1001, Accountability Rating System

Effective Date: July 31, 2008.

Amended 19 TAC Chapter 97, Planning and Accountability, Subchapter AA, Accountability and Performance Monitoring, §97.1001, Accountability Rating System, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on July 11, 2008.

The adopted amendment adopts applicable excerpts of the 2008 Accountability Manual. Changes were made to the manual excerpts adopted as rule since published as proposed. No changes were made to the rule since published as proposed.

2. Adopted New 19 TAC Chapter 102, Educational Programs, Subchapter EE, Commissioner's Rules Concerning Pilot Programs, §102.1054, Intensive Summer Pilot Program

Effective Date: July 31, 2008.

New 19 TAC Chapter 102, Educational Programs, Subchapter EE, Commissioner's Rules Concerning Pilot Programs, §102.1054, Intensive Summer Pilot Program, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on July 11, 2008.

The adopted new rule implements the requirements of the Texas Education Code, §29.098, as added by House Bill 2237, 80th Texas Legislature, 2007, which requires the commissioner of education to establish by rule procedures for the awarding of grants for intensive summer programs. The new rule was adopted with changes from what was published as proposed.

3. Adopted New 19 TAC Chapter 102, Educational Programs, Subchapter EE, Commissioner's Rules Concerning Pilot Programs, §102.1055, Collaborative Dropout Reduction Pilot Program

Effective Date: July 31, 2008.

New 19 TAC Chapter 102, Educational Programs, Subchapter EE, Commissioner's Rules Concerning Pilot Programs, §102.1055, Collaborative Dropout Reduction Pilot Program, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on July 11, 2008.

The adopted new rule implements the requirements of the Texas Education Code, §29.096, as added by House Bill 2237, 80th Texas Legislature, 2007, which requires the commissioner of education to adopt rules to administer the Collaborative Dropout Reduction Pilot Program. The new rule was adopted with changes from what was published as proposed.

4. Adopted Amendment to 19 TAC Chapter 109, Budgeting, Accounting, and Auditing, Subchapter C, Adoptions by Reference, §109.41, Financial Accountability System Resource Guide (PDF)

Effective Date: July 31, 2008.

Amended 19 TAC Chapter 109, Budgeting, Accounting, and Auditing, Subchapter C, Adoptions by Reference, §109.41, Financial Accountability System Resource Guide, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on July 11, 2008.

Under §109.41(b), the commissioner of education shall amend the "Resource Guide," adopting it by reference, as needed. The adopted amendment includes updates to the state compensatory education module and the accounting and auditing modules to reflect new accounting and auditing rules and standards. Part of the update includes the addition of new account codes and the deletion of some account codes. The charter school supplement was also be updated to reflect these changes in accounting and auditing rules and standards. The Resource Guide is available on the TEA website at http://www.tea.state.tx.us/index4.aspx?id=8444. The amendment was adopted with changes from what was published as proposed.
