September 2008 Summary of Commissioner Rule Actions

 

1. Adopted Amendment to 19 TAC Chapter 61, School Districts, Subchapter CC, Commissioner's Rules Concerning School Facilities, §61.1036, School Facilities Standards for Construction on or after January 1, 2004

Effective Date: September 24, 2008.

Amended 19 TAC Chapter 61, School Districts, Subchapter CC, Commissioner's Rules Concerning School Facilities, §61.1036, School Facilities Standards for Construction on or after January 1, 2004, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on September 4, 2008.

The adopted amendment adds to the existing facilities standards inspection requirements for portable, modular school buildings, in accordance with House Bill 1886, 80th Texas Legislature, 2007. The amendment also incorporates other revisions, such as adding several definitions, modifying certain existing definitions, and updating the name of a state agency and a statutory reference. No changes were made to the rule since published as proposed.

2. Adopted Amendment to 19 TAC Chapter 97, Planning and Accountability, Subchapter AA, Accountability and Performance Monitoring, §97.1004, Adequate Yearly Progress

Effective Date: September 30, 2008.

Amended 19 TAC Chapter 97, Planning and Accountability, Subchapter AA, Accountability and Performance Monitoring, §97.1004, Adequate Yearly Progress, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on September 10, 2008.

The amendment adopts applicable excerpts, Sections II-V, of the 2008 Adequate Yearly Progress Guide. No changes were made to the rule or guide since published as proposed.

3. Adopted New 19 TAC Chapter 101, Assessment, Subchapter FF, Commissioner's Rules Concerning Diagnostic Assessment, §101.6001, Texas Middle School Diagnostic Reading Assessment

Effective Date: October 14, 2008.

New 19 TAC Chapter 101, Assessment, Subchapter FF, Commissioner's Rules Concerning Diagnostic Assessment, §101.6001, Texas Middle School Diagnostic Reading Assessment, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on September 24, 2008.

The adopted new rule implements the requirement of the Texas Education Code, §28.006(c-1), which requires each school district to administer at the beginning of the seventh grade a reading instrument to each student whose performance on the assessment instrument in reading in Grade 6 did not demonstrate reading proficiency. No changes were made to the rule since published as proposed.
