This item provides an opportunity for the board to be briefed on current agenda items and Texas Education Agency and legislative activities.

2. Report and Recommendations from the Commissioner of Education Regarding Instructional Materials Offered for Adoption under Midcycle 2011 Proclamation
This item will present the report and recommendations from the commissioner of education that instructional materials offered for adoption be placed on the conforming list, on the nonconforming list, or be rejected. The Midcycle 2011 Proclamation instructional materials will be used by school districts and open-enrollment charter schools beginning with school year 2011-2012. Midcycle 2011 Proclamation programs that were submitted for adoption include Career and Technical Education. Recommendations will also be made regarding correction of factual errors to be required in adopted materials. Statutory authority for this action is the Texas Education Code (TEC), §§31.022, 31.0221, 31.023, and 31.024.

3. Proposed New 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter C, High School, §§126.32-126.35, 126.37, and 126.48
(Second Reading and Final Adoption)
This item presents for second reading and final adoption proposed new 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter C, High School, §§126.32, Fundamentals of Computer Science (One Credit), Beginning with School Year 2012-2013; 126.33, Computer Science I (One-Half to One Credit), Beginning with School Year 2012-2013; 126.34, Computer Science II (One Credit), Beginning with School Year 2012-2013; 126.35, Computer Science III (One Credit), Beginning with School Year 2012-2013; 126.37, Discrete Mathematics (One-Half to One Credit), Beginning with School Year 2012-2013; and 126.48, Web Game Development (One Credit), Beginning with School Year 2012-2013. The proposed new rules recommend an implementation date of the 2012-2013 school year for the new high school technology applications Texas Essential Knowledge and Skills (TEKS). Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

4. Public Hearing Regarding Instructional Materials Submitted for Adoption by the State Board of Education Under The Request for Supplemental Science Materials
A public hearing before the State Board of Education (SBOE) is scheduled for Thursday, July 21, 2011, in the William B. Travis Building, Room 1-104. Testimony will be presented regarding instructional materials submitted for adoption under the Request for Supplemental Science Materials. Texas residents who have registered to speak on this agenda item will be given priority over non-Texas residents. Oral testimony will be limited to two minutes and speakers are asked to provide 35 copies of their testimony for distribution. Representatives of publishing companies will be allowed to provide oral responses to testimony at the hearing. Publishers will also have the opportunity to file written responses following the hearing. These instructional materials were reviewed by the state review panels in June of 2011. Statutory authority is 19 Texas Administrative Code (TAC) §66.60(b) and Texas Education Code (TEC), §28.002.

5. Report and Recommendations from the Commissioner of Education Regarding Instructional Materials Offered for Adoption under The Request for Supplemental Science Materials
The Request for Supplemental Science Materials of the State Board of Education (SBOE) calls for new supplemental science instructional materials to be used in school districts and open-enrollment charter schools beginning in school year 2011-2012. The Request for Supplemental Science Materials includes science, grades 5-8; Biology; Chemistry; Integrated Physics and Chemistry (IPC); and Physics. This item will present the report and recommendations from the commissioner of education that the supplemental instructional materials offered for adoption be placed on the adopted list or be rejected. Recommendations will also be made regarding manufacturing standards and specifications and correction of factual errors to be required in adopted materials. Statutory authority for this action is the Texas Education Code (TEC), §31.035.

6. Discussion of Pending Litigation
The State Board of Education will enter executive session in accordance with the Texas Government Code, §551.071(1)(A), to discuss pending and contemplated litigation with the general counsel, legal staff, and if necessary, attorney(s) from the Attorney General's Office. The Committee of the Full Board will meet in Room 1-103 to discuss any litigation arising after the date of posting.
