3. Report and Recommendations from the Commissioner of Education Regarding Instructional Materials Offered for Adoption under Midcycle 2011 Proclamation

This item will present the report and recommendations from the commissioner of education that instructional materials offered for adoption be placed on the conforming list, on the nonconforming list, or be rejected. The Midcycle 2011 Proclamation instructional materials will be used by school districts and open-enrollment charter schools beginning with school year 2011-2012. Midcycle 2011 Proclamation programs that were submitted for adoption include Career and Technical Education. Recommendations will also be made regarding correction of factual errors to be required in adopted materials. Statutory authority for this action is the Texas Education Code (TEC), §§31.022, 31.0221, 31.023, and 31.024.

4. Proposed New 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter C, High School, §§126.32-126.35, 126.37, and 126.48
(Second Reading and Final Adoption) 

This item presents for second reading and final adoption proposed new 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter C, High School, §§126.32, Fundamentals of Computer Science (One Credit), Beginning with School Year 2012-2013; 126.33, Computer Science I (One-Half to One Credit), Beginning with School Year 2012-2013; 126.34, Computer Science II (One Credit), Beginning with School Year 2012-2013; 126.35, Computer Science III (One Credit), Beginning with School Year 2012-2013; 126.37, Discrete Mathematics (One-Half to One Credit), Beginning with School Year 2012-2013; and 126.48, Web Game Development (One Credit), Beginning with School Year 2012-2013. The proposed new rules recommend an implementation date of the 2012-2013 school year for the new high school technology applications Texas Essential Knowledge and Skills (TEKS). Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

5. Report and Recommendations from the Commissioner of Education Regarding Instructional Materials Offered for Adoption under The Request for Supplemental Science Materials

The Request for Supplemental Science Materials of the State Board of Education (SBOE) calls for new supplemental science instructional materials to be used in school districts and open-enrollment charter schools beginning in school year 2011-2012. The Request for Supplemental Science Materials includes science, grades 5-8; Biology; Chemistry; Integrated Physics and Chemistry (IPC); and Physics. This item will present the report and recommendations from the commissioner of education that the supplemental instructional materials offered for adoption be placed on the adopted list or be rejected. Recommendations will also be made regarding manufacturing standards and specifications and correction of factual errors to be required in adopted materials. Statutory authority for this action is the Texas Education Code (TEC), §31.035.

6. Adoption of Review of 19 TAC Chapter 102, Educational Programs, Subchapter A, Grants
(Adoption of Review)

Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board of Education (SBOE) rules. This item presents the adoption of the review of 19 TAC Chapter 102, Educational Programs, Subchapter A, Grants. The rule being reviewed provides guidelines for the State Engineering and Science Recruitment Fund (SENSR) Grant Program. The statutory authority for the rule review is Texas Government Code, §2001.039. The statutory authority for 19 TAC Chapter 102, Subchapter A, is the Texas Education Code (TEC), §51.603 and §51.605.

7. Per Capita Apportionment Rate for the 2010-2011 School Year 

The board is responsible for setting a per capita apportionment rate for each school year based on an estimate of the amount available for expenditures from the Available School Fund. The recommended revised rate for the 2010-2011 school year will be proposed at the July meeting of the Committee on School Finance/Permanent School Fund. Statutory authority for this action is the Texas Education Code, (TEC) §42.004 and §43.001(b).

8. Approval of a Pool of Qualified Respondents to the RFQ for Real Estate Investment Managers for the Permanent School Fund and Approval of Investments in Real Estate Funds

This item provides an opportunity for the committee and board to approve a pool of qualified respondents to the RFQ for real estate investment managers for the Permanent School Fund and approval of investments in real estate funds. Statutory authority for this action is the Texas Constitution, Article VII, §5(f).

9. Approval of Implementation and Investment in Inflation Linked Bonds as Part of the Real Return Allocation

This item provides an opportunity for the committee and board to approve implementation and investment in inflation linked bonds as part of the real return allocation. Statutory authority for this action is the Texas Constitution, Article VII, §5(f).

10. Proposed Amendments to the Investment Procedures Manual

This item provides an opportunity for the committee and board to review and adopt proposed amendments to the Investment Procedures Manual. Statutory authority for this action is the Texas Constitution, Article VII, §5(f).

11. Presentation and Review of the Absolute Return Portfolios Managed for the Permanent School Fund

This item provides an opportunity for the committee and board to receive a presentation and to review the absolute return portfolios managed for the Permanent School Fund. Consideration will be given to potential structural and allocation changes within the investments. Statutory authority for this action is the Texas Constitution, Article VII, §5(f).

12. Proposed Guidelines and Application for Open-Enrollment Charters

This item provides the State Board of Education (SBOE) an opportunity to adopt the request for application and timeline for the seventeenth generation of open-enrollment charter schools. Statutory authority for this action is the Texas Education Code (TEC), §12.101 and §12.110.

13. Adoption of Governance Reporting Form for Open-Enrollment Charter Schools

This item provides the State Board of Education (SBOE) an opportunity to approve a governance reporting form for open-enrollment charter schools. Statutory authority for this action is the Texas Education Code (TEC), §12.119.

14. Proposed Guidelines and Application for Public College or University Charters

This item provides the State Board of Education (SBOE) an opportunity to adopt the request for application form for public college or university open-enrollment charters. Statutory authority for this action is the Texas Education Code (TEC), §12.152 and §12.154.

5. 2009-2013 Rule Review Plan for State Board of Education Rules

This item outlines the rule review plan for State Board of Education (SBOE) rules during the period of September 2009 through August 2013. Texas Government Code, §2001.039, requires the rule review of existing state agency rules, including SBOE rules. The rule review requirement is designed to ensure that the reason for initially adopting a rule continues to exist.

6. Review of Annual Audit Plan of the Division of Financial Audits for 2011-2012

This item covers the annual audit plan of the Division of Financial Audits for the
2011-2012 school year. The annual audit plan describes the numbers and types of audits, areas or documents to be examined, and the scheduled time periods for accomplishing the division’s activities during the 2011-2012 fiscal year. The commissioner of education submits the annual audit plan to the Committee on School Finance/Permanent School Fund in accordance with 19 TAC Chapter 109, Texas Education Agency Audit Functions, §109.21, Annual Audit Plan.
