Proposed Repeal of 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter A, Elementary, §§113.1-113.7, Subchapter B, Middle School, §§113.21-113.24, and Subchapter C, High School, §§113.31-113.39, and 19 TAC Chapter 118, Texas Essential Knowledge and Skills for Economics with Emphasis on the Free Enterprise System and Its Benefits, Subchapter A, High School, §118.1 and §118.2, and Proposed Amendments to 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, §§113.10, 113.17, and 113.40, and 19 TAC Chapter 118, Texas Essential Knowledge and Skills for Economics with Emphasis on the Free Enterprise System and Its Benefits, §118.3

This item presents for second reading and final adoption the proposed repeal of 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter A, Elementary, §§113.1-113.7, Subchapter B, Middle School, §§113.21-113.24, and Subchapter C, High School, §§113.31-113.39, and 19 TAC Chapter 118, Texas Essential Knowledge and Skills for Economics with Emphasis on the Free Enterprise System and Its Benefits, Subchapter A, High School, §118.1 and §118.2. The proposed repeal would remove the Texas Essential Knowledge and Skills (TEKS) adopted to be effective in 1998 for Kindergarten-Grade 8 and high school social studies and economics courses, and related implementation language, that will be superseded by 19 TAC §§113.10-113.20 and 113.40-113.48 and 19 TAC §118.3 and §118.4 of these chapters beginning with the 2011-2012 school year. This item also presents for second reading and final adoption proposed amendments to 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, §§113.10, 113.17, and 113.40, and 19 TAC Chapter 118, Texas Essential Knowledge and Skills for Economics with Emphasis on the Free Enterprise System and Its Benefits, §118.3, to remove references to rules that would be repealed. No additional changes are recommended since approved for first reading. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.
4. Proposed Revisions to 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter C, General Educational Development

This item presents for first reading and filing authorization proposed revisions to 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter C, General Educational Development. The proposed revisions would incorporate changes resulting from Senate Bill (SB) 1094, 82nd Texas Legislature, 2011, and recent board discussion. Statutory authority for this action is the Texas Education Code (TEC), §7.111, as amended by SB 1094, 82nd Texas Legislature, 2011.

5. Per Capita Apportionment Rate for 2011-2012 School Year
The board is responsible for setting a per capita apportionment rate for each school year based on an estimate of the amount available for expenditures from the Available School Fund. The recommended rate for the 2011-2012 school year will be proposed at the September meeting of the Committee on School Finance/Permanent School Fund. Statutory authority for this action is the Texas Education Code, (TEC) §42.004 and §43.001(b).
6. Proposed Amendment to 19 TAC Chapter 105, Foundation School Program, Subchapter B, Use of State Funds, §105.11, Maximum Allowable Indirect Cost
(First Reading and Filing Authorization)
This item presents proposed amendment to 19 TAC Chapter 105, Foundation School Program, Subchapter B, Use of State Funds, §105.11, Maximum Allowable Indirect Cost, for first reading and filing authorization. The proposed amendment would update the rule to reflect a change to the use of special program allotments for indirect or administrative expenses, in accordance with Senate Bill (SB) 1, 82nd Texas Legislature, First Called Session, 2011. Statutory authority for this action is the Texas Education Code (TEC), §§42.1541, 42.152(c), 42.151(h), 42.153(b), 42.154(a-1) and (c), and 42.156(b).
7. Approval of a Pool of Qualified Respondents to the RFQ for Real Estate Investment Managers for the Permanent School Fund and Approval of Investments in Real Estate Funds
This item provides an opportunity for the committee and board to approve a pool of qualified respondents to the RFQ for real estate investment managers for the Permanent School Fund and approval of investments in real estate funds. Statutory authority for this action is the Texas Constitution, Article VII, §5(f).
8. Presentation and Review of the Absolute Return Portfolios Managed for the Permanent School Fund
This item provides an opportunity for the committee and board to receive a presentation and to review the absolute return portfolios managed for the Permanent School Fund. Consideration will be given to potential structural and allocation changes within the investments. Statutory authority for this action is the Texas Constitution, Article VII, §5(f).

This item provides the board an opportunity to approve the operation of additional open-enrollment charter schools for opening in school year 2013-2014. Following are the 15 sponsoring entities for the Generation 16 open-enrollment charter school applicants: Academy for Technological Advancement; Austin Achieve Public Schools, Inc.; Bridge to Tomorrow; Center for Teaching and Learning, Inc.; El Paso Connections, Inc.; El Paso Country Day School; Luz Para Las Naciones, Inc.; Fallbrook Community Development Center; Hope Academy, Inc.; L B Williams Dual Language Academy; Full Gospel Fellowship of Churches and Ministers International, Inc.; Uplift Fort Worth CDC; Florida High School for Accelerated Learning-North Lee Co. Campus; Pro Vision Educational Services, Inc.; and UMEP, Inc. Statutory authority for this action is the Texas Education Code (TEC), §12.101.

This item lists charter school amendments that were acted upon by the commissioner of education between June 1, 2011 and July 31, 2011.
5. 2009-2013 Rule Review Plan for State Board of Education Rules
This item outlines the rule review plan for State Board of Education (SBOE) rules during the period of September 2009 through August 2013. Texas Government Code, §2001.039, requires the rule review of existing state agency rules, including SBOE rules. The rule review requirement is designed to ensure that the reason for initially adopting a rule continues to exist.
6. State Board of Education Meeting Schedule for 2012
According to the Texas Education Code, §7.106, the State Board of Education (SBOE) is to hold four meetings a year in Austin, Texas on dates determined by the chair. The SBOE may also hold other meetings as may be called by the chair. The purpose of this item is to announce SBOE meeting dates in 2012.
