Proposed Amendments to 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, §74.1, Essential Knowledge and Skills, and §74.3, Description of a Required Secondary Curriculum, and Proposed New Chapter 74, Subchapter G, Graduation Requirements, Beginning with School Year 2012-2013

This item presents for first reading and filing authorization proposed amendments to 19 TAC Chapter 74, Curriculum Requirements, §74.1, Essential Knowledge and Skills, and §74.3, Description of a Required Secondary Curriculum, and proposed new Chapter 74, Subchapter G, Graduation Requirements, Beginning with School Year 2012-2013. The proposed amendments would update requirements for school districts to align with recently passed legislation and provide additional clarification regarding requirements. The proposed new subchapter would update the graduation requirements to align with recently passed legislation, allow additional courses to satisfy certain graduation requirements, and provide additional clarification regarding requirements. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, 28.025, and 28.027.

This item provides the opportunity for the committee to discuss proposed revisions to 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter A, Elementary, Subchapter B, Middle School, Subchapter C, High School, and Subchapter D, Other High School Mathematics Courses. 4. Review of 19 TAC Chapter 66, State Adoption and Distribution of Instructional Materials, and Discussion of Proposed Revisions to 19 TAC Chapter 66, State Adoption and Distribution of Instructional Materials
Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board of Education (SBOE) rules. This item presents the review of 19 TAC Chapter 66, State Adoption and Distribution of Instructional Materials. The rules being reviewed establish procedures for the adoption, purchase, and distribution of instructional materials. This item also provides an opportunity for the committee to discuss proposed revisions to the instructional materials review and adoption process in 19 TAC Chapter 66 resulting from Senate Bill (SB) 6, 82nd Texas Legislature, First Called Session, 2011. Statutory authority for the rule review is Texas Government Code, §2001.039. Statutory authority for 19 TAC Chapter 66 is the Texas Education Code (TEC), §7.102(c)(23) and §31.003.

5. Discussion of Pending Litigation
The State Board of Education will enter executive session in accordance with the Texas Government Code, §551.071(1)(A), to discuss pending and contemplated litigation with the general counsel, legal staff, and, if necessary, attorney(s) from the Attorney General's Office. The Committee of the Full Board will meet in Room 1-103 to discuss this item. Cases to be discussed may include: Texas Taxpayer & Student Fairness Coalition; Hillsboro ISD, Hutto ISD, Nacogdoches ISD, Pflugerville ISD, San Antonio ISD, Taylor ISD, Van ISD, Randy Pittenger, Chip Langston; and Shelby Davidson, as Next of Friend of Cortland, Carli and Casi Davidson v. Robert Scott, Commissioner of Education, in his Official Capacity; Susan Combs, Texas Comptroller of Public Accounts, in her Official Capacity; Texas State Board of Education; in the 200th Judicial District Court of Travis County, Texas D-1-GN-11-003130; and any other litigation arising after the date of posting or reasonably contemplated as of the date of the board meeting.
