SUMMARY:
This item presents for first reading and filing authorization proposed amendment to
19 TAC Chapter 118, Texas Essential Knowledge and Skills for Economics with Emphasis on the Free Enterprise System and Its Benefits, Subchapter A, High School, §118.4, Economics with Emphasis on the Free Enterprise System and Its Benefits, High School (One-Half Credit), Beginning with School Year 2011-2012. The proposed amendment would add methods of paying for college and other postsecondary education and training to the standards for personal financial literacy to align with House Bill (HB) 34, 82nd Texas Legislature, Regular Session, 2011.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, 28.0021, and 28.025.

EFFECTIVE DATE: The proposed effective date of the proposed amendment to 19 TAC §118.4 is August 27, 2012.

PREVIOUS BOARD ACTION: The State Board of Education (SBOE) initially adopted the Texas Essential Knowledge and Skills (TEKS) for Economics with Emphasis on the Free Enterprise System and Its Benefits to be effective September 1, 1998. Revisions to the economics TEKS were adopted by the SBOE to be effective August 23, 2010, for implementation beginning with the 2010-2011 school year. Effective October 17, 2011, the SBOE repealed the economics TEKS initially adopted in 1998.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: The 82nd Texas Legislature, 2011, passed HB 34, amending the TEC, §28.0021. HB 34 added methods of paying for college and other postsecondary education and training to the standards for personal financial literacy in high school economics courses.

The proposed amendment to 19 TAC Chapter 118, Texas Essential Knowledge and Skills for Economics with Emphasis on the Free Enterprise System and Its Benefits, Subchapter A, High School, §118.4, Economics with Emphasis on the Free Enterprise System and Its Benefits, High School (One-Half Credit), Beginning with School Year 2011-2012, would make the rule for high school economics courses comply with requirements mandated by HB 34.

It is necessary for this item to be presented for first reading and filing authorization in November to meet the TEC, §28.0021(c), which requires the SBOE to identify the essential knowledge and skills of personal financial literacy instruction to include instruction in methods of paying for college and other postsecondary education and training by January 31, 2012.

FISCAL IMPACT: The Texas Education Agency has determined that there are no additional costs to persons or entities required to comply with the proposed rule action. In addition, there is no direct adverse economic impact for small businesses and microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.

PUBLIC AND STUDENT BENEFIT: Benefits include additional support for students in preparing for and paying for college.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed rule action would have no new procedural and reporting requirements.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed rule action would have no new locally maintained paperwork requirements.

PUBLIC COMMENTS: The official public comment period will begin when the amendment is published as proposed in the Texas Register.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES: A request for a public hearing on the proposal submitted under the Administrative Procedure Act must be received by the commissioner of education not more than 14 calendar days after notice of the proposal has been published in the Texas Register.

COMMISSIONER'S RECOMMENDATION: I recommend that the State Board of Education:

Approve for first reading and filing authorization the proposed amendment to 19 TAC Chapter 118, Texas Essential Knowledge and Skills for Economics with Emphasis on the Free Enterprise System and Its Benefits, Subchapter A, High School, §118.4, Economics with Emphasis on the Free Enterprise System and Its Benefits, High School (One-Half Credit), Beginning with School Year 2011-2012.
