STATE BOARD OF EDUCATION: NO ACTION
SUMMARY: At the request of a board member, this item provides the opportunity for the committee to discuss a proposed amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.26, Award of Credit. The proposed amendment would adjust language to clarify award of credit as it relates to the statutory requirement that performance on an end-of-course assessment count for 15 percent of a student's grade.
STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.
BOARD RESPONSE: This item is presented for review and comment.
PREVIOUS BOARD ACTION: The State Board of Education (SBOE) adopted 19 TAC Chapter 74, Subchapter C, to be effective September 1, 1996. Section 74.26 was last amended to be effective September 1, 2001.
FUTURE ACTION EXPECTED: At the direction of the board, a proposed amendment to 19 TAC §74.26, Award of Credit, can be presented for first reading and filing authorization at a future meeting.
BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: The 81st Texas Legislature, 2009, passed House Bill (HB) 3, amending the TEC, §28.025, to increase flexibility in graduation requirements for students. While HB 3 removed SBOE authority to designate a specific course or a specific number of credits in the enrichment curriculum as requirements for the Recommended High School Program, the SBOE retains authority in the foundation and enrichment curriculum for the Minimum High School Program and the Distinguished Achievement Program. Through 19 TAC §74.26, the SBOE establishes provisions for awarding credit for satisfactory completion of state and local requirements.
The proposed amendment to 19 TAC §74.26 would add language to subsection (c) to address awarding of credit for courses required for graduation in relation to state end-of-course assessments.
FISCAL IMPACT: None.
PUBLIC AND STUDENT BENEFIT: Benefits may include added flexibility for school districts in awarding credit.
PROCEDURAL AND REPORTING IMPLICATIONS: The proposed amendment would have no new procedural and reporting requirements.
LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed amendment would have no new locally maintained paperwork requirements.
