December 2011 Summary of Commissioner Rule Actions

 

1. Adopted Amendment to 19 TAC Chapter 61, School Districts, Subchapter CC, Commissioner's Rules Concerning School Facilities, §61.1034, New Instructional Facility Allotment

Effective Date: January 2, 2012.

Amended 19 TAC Chapter 61, School Districts, Subchapter CC, Commissioner's Rules Concerning School Facilities, §61.1034, New Instructional Facility Allotment, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on December 13, 2011.

The adopted amendment modifies the rule to reflect statutory changes, implement a recent Texas Education Agency policy decision to allow open-enrollment charter schools to apply for the allotment, amend the application process, and establish in rule a requirement for applicants to complete a survey after receiving funds. The amendment was adopted without changes from what was published as proposed.

2. Adopted Amendment to 19 TAC Chapter 62, Commissioner's Rules Concerning the Equalized Wealth Level, §62.1071, Manual for Districts Subject to Wealth Equalization

Effective Date: January 4, 2012.

Amended 19 TAC Chapter 62, Commissioner's Rules Concerning the Equalized Wealth Level, §62.1071, Manual for Districts Subject to Wealth Equalization, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on December 15, 2011.

The amendment adopts as a part of the Texas Administrative Code the Manual for Districts Subject to Wealth Equalization 2011-2012 School Year. The manual contains the processes and procedures that the Texas Education Agency uses in the administration of the provisions of the Texas Education Code (TEC), Chapter 41, and the fiscal, procedural, and administrative requirements that school districts subject to the TEC, Chapter 41, must meet. The amendment was adopted without changes from what was published as proposed.

3. Adopted Revisions to 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter EE, Commissioner's Rules Concerning the Communities In Schools Program

Effective Date: December 27, 2011.

Revised 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter EE, Commissioner's Rules Concerning the Communities In Schools Program, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on December 7, 2011.

The adopted revisions clarify the requirements of the Texas Education Code (TEC), §33.154, which requires the commissioner of education by rule to develop and implement policies concerning the Communities In Schools (CIS) program. In addition, the adopted revisions clarify requirements under the TEC, §33.155 and §33.156, relating to the effectiveness and funding of the CIS program. The revisions were adopted without changes from what was published as proposed.

4. Adopted Repeal of 19 TAC Chapter 101, Assessment, Subchapter AA, Commissioner's Rules Concerning the Participation of Limited English Proficient Students in State Assessments, and New 19 TAC Chapter 101, Assessment, Subchapter AA, Commissioner's Rules Concerning the Participation of English Language Learners in State Assessments

Effective Date: December 22, 2011.

Repealed 19 TAC Chapter 101, Assessment, Subchapter AA, Commissioner's Rules Concerning the Participation of Limited English Proficient Students in State Assessments, and New 19 TAC Chapter 101, Assessment, Subchapter AA, Commissioner's Rules Concerning the Participation of English Language Learners in State Assessments, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on December 2, 2011.

The adopted rule actions reflect changes to the state assessment program beginning with the implementation of the State of Texas Assessments of Academic Readiness (STAAR) in the 2011-2012 school year. The rule actions were adopted with and without changes from what was published as proposed.
