STATE BOARD OF EDUCATION: CONSENT

SUMMARY:
This item presents for first reading and filing authorization the proposed repeal of 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter A, Elementary, §§111.11-111.17, Subchapter B, Middle School, §§111.21-111.24, Subchapter C, High School, §§111.31-111.37, and Subchapter D, Other High School Mathematics Courses, §111.52. The proposed repeal would remove the mathematics Texas Essential Knowledge and Skills (TEKS) currently in effect for Kindergarten-Grade 8 and high school courses that will be superseded by proposed new 19 TAC §§111.1-111.7, 111.25-111.28, and 111.38-111.45 beginning with the 2013-2014 school year.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

EFFECTIVE DATE: The proposed effective date of the proposed repeal is August 26, 2013.

PREVIOUS BOARD ACTION: The State Board of Education (SBOE) adopted the TEKS for Algebra I, Algebra II, and Geometry to be effective September 1, 1996, and adopted the TEKS for elementary, middle school, Precalculus, Mathematical Models with Applications, and other high school mathematics courses to be effective September 1, 1998. The mathematics TEKS in 19 TAC Chapter 111, Subchapters A-C, were amended to be effective August 1, 2006 and February 22, 2009. The mathematics TEKS in 19 TAC Chapter 111, Subchapter D, were amended to be effective October 21, 2007 and July 12, 2010. The SBOE adopted the TEKS for Advanced Quantitative Reasoning to be effective August 22, 2011.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: The SBOE is considering for first reading and filing authorization proposed revisions to the mathematics TEKS as a separate item in this agenda. If adopted, the revised mathematics TEKS are scheduled to be implemented in the 2013-2014 school year. At that time, those revisions will supersede the current mathematics TEKS. Therefore, the current mathematics TEKS will no longer be needed and may be repealed with an effective date of August 26, 2013. The proposed effective date will allow the current mathematics TEKS to remain in effect until the revised mathematics TEKS are implemented.

FISCAL IMPACT: The Texas Education Agency (TEA) has determined that there are no additional costs to persons or entities required to comply with the proposed repeal. In addition, there is no direct adverse economic impact for small businesses and microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.

PUBLIC AND STUDENT BENEFIT: Benefits include better alignment of the TEKS and coordination of the standards with the adoption of instructional materials.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed repeal would have no procedural and reporting requirements.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed repeal would have no locally maintained paperwork requirements.

PUBLIC COMMENTS: The official public comment period will begin when the repeal is published as proposed in the Texas Register.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES: To reduce the volume of the agenda and the cost of printing, the text of the proposed repeal of 19 TAC §§111.11-111.17, 111.21-111.24, 111.31-113.37, and 111.52 is not presented in this agenda. Proposed revisions to 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter A, Elementary, Subchapter B, Middle School, Subchapter C, High School, and Subchapter D, Other High School Mathematics Courses, are presented for first reading and filing authorization as a separate item in this agenda.

A public hearing regarding the proposed revisions to 19 TAC Chapter 111, Subchapters A-D, is also included as a separate item in this agenda.

A request for a public hearing on the proposed repeal of 19 TAC §§111.11-111.17, 111.21-111.24, 111.31-113.37, and 111.52 submitted under the Administrative Procedure Act must be received by the commissioner of education not more than 14 calendar days after notice of the proposal has been published in the Texas Register.

COMMISSIONER'S RECOMMENDATION: I recommend that the State Board of Education:

Approve for first reading and filing authorization the proposed repeal of 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter A, Elementary, §§111.11-111.17, Subchapter B, Middle School, §§111.21-111.24, Subchapter C, High School, §§111.31-111.37, and Subchapter D, Other High School Mathematics Courses, §111.52.
