Discussion of Proclamation 2014 of the State Board of Education
Advertising for Bids on Instructional Materials

STATE BOARD OF EDUCATION: NO ACTION

SUMMARY:
The new adoption cycle for instructional materials is scheduled to be approved by the State Board of Education (SBOE) in January 2012. Instructional materials submitted under Proclamation 2014 are scheduled for adoption by the SBOE in November 2013. This item provides an opportunity for the SBOE to discuss the schedule of events and instructional materials to be included in Proclamation 2014.

STATUTORY AUTHORITY: Texas Education Code (TEC), §31.022.

BOARD RESPONSE: This item is presented for review and comment.

PREVIOUS BOARD ACTION: Proclamation 2010 was issued by the SBOE in November 2007. Proclamation 2011 was issued by the SBOE in May 2008. In May 2010, the board voted to postpone Proclamation 2012 indefinitely. In its place, the board issued a Request for Supplemental Science Materials for science, grades 5-8; biology; chemistry; Integrated Physics and Chemistry (IPC); and physics.

FUTURE ACTION EXPECTED: Proclamation 2014 is scheduled to be presented for SBOE approval at the April 2012 meeting.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: In November 2011, the SBOE conducted a work session to discuss possible options and make recommendations for a new review and adoption cycle. The SBOE is scheduled to approve a new review and adoption cycle at the January 2012 meeting. House Bill 188, passed by the 80th Texas Legislature, requires the SBOE to designate each proclamation by the school year in which the textbooks are intended to be made available in classrooms and not by the school year in which the board makes the request for production. The draft of Proclamation 2014 was not available at the time this item was prepared. It will be provided to SBOE members prior to the January meeting.

FISCAL IMPACT: Senate Bill 6, passed by the 82nd Texas Legislature created an Instructional Materials Allotment (IMA) for the purchase of instructional materials, technological equipment, and technology-related services. An allotment is credited to each district’s instructional materials account as provided by TEC, Section 31.0212. Remaining funds can be carried forward to the next school year as well as the next biennium. The IMA for the 2014-2015 biennium is expected to be available for district purchase of Proclamation 2014 materials.

PUBLIC AND STUDENT BENEFIT: New instructional materials will be scheduled for adoption in November 2013 for use beginning in the 2014-2015 school year.

PROCEDURAL AND REPORTING IMPLICATIONS: None.

PUBLIC COMMENTS: In accordance with 19 Texas Administrative Code (TAC) §66.27(c), a draft copy of Proclamation 2014 will be provided to designated representatives of the publishing industry to solicit comments on the content of Proclamation 2014. A public meeting with representatives of the publishing industry will be scheduled accordingly.
