Proposed Repeal of 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter A, Elementary, §§126.1-126.3, Subchapter B, Middle School, §126.11 and §126.12, and Subchapter C, High School, §§126.21-126.29

STATE BOARD OF EDUCATION: CONSENT

SUMMARY:
This item presents for first reading and filing authorization the proposed repeal of 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter A, Elementary, §§126.1-126.3, Subchapter B, Middle School, §126.11 and §126.12, and Subchapter C, High School, §§126.21-126.29. The proposed repeal would remove the Texas Essential Knowledge and Skills (TEKS) adopted effective in 1998 for Kindergarten-Grade 8 and high school technology applications courses, and related implementation language, that will be superseded by 19 TAC §§126.5-126.7, 126.13-126.16, and 126.31-126.50 of this chapter beginning with the 2012-2013 school year.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

EFFECTIVE DATE: The proposed effective date of the proposed repeal is August 27, 2012.

PREVIOUS BOARD ACTION: The SBOE adopted the TEKS for technology applications effective September 1, 1998. Revisions to 19 TAC Chapter 126, Subchapters A-C, and new 19 TAC Chapter 126, Subchapter D, were adopted effective September 26, 2011, with an implementation date of the 2012-2013 school year.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: In April 2011, the SBOE adopted revisions to the technology applications TEKS for Kindergarten-Grade 8 and for 13 high school courses. In July 2011, the SBOE adopted revisions to the technology applications TEKS for six additional high school courses. The revised technology applications TEKS will be implemented in the 2012-2013 school year. These revisions will supersede the original TEKS at the time of implementation. With the implementation of the revised technology applications TEKS in the 2012-2013 school year, the TEKS adopted in 1998 will no longer be needed and may be repealed with an effective date of August 27, 2012.

FISCAL IMPACT: The Texas Education Agency (TEA) has determined that there are no additional costs to persons or entities required to comply with the proposed repeal. In addition, there is no direct adverse economic impact for small businesses and microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.

PUBLIC AND STUDENT BENEFIT: Benefits include better alignment of the TEKS and coordination of the standards with the adoption of instructional materials.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed repeal would have no procedural and reporting requirements.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed repeal would have no locally maintained paperwork requirements.

PUBLIC COMMENTS: The official public comment period will begin when the repeal is published as proposed in the Texas Register.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES: A request for a public hearing on the proposal submitted under the Administrative Procedure Act must be received by the commissioner of education not more than 14 calendar days after notice of the proposal has been published in the Texas Register.

To reduce the volume of the agenda and the cost of printing, the text of the proposed repeal of 19 TAC §§126.1-126.3, 126.11, 126.12, and 126.21-126.29 is not presented in this agenda. COMMISSIONER'S RECOMMENDATION: I recommend that the State Board of Education:

Approve for first reading and filing authorization the proposed repeal of 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter A, Elementary, §§126.1-126.3, Subchapter B, Middle School, §126.11 and §126.12, and Subchapter C, High School, §§126.21-126.29.
