Review of Open-Enrollment Charter School Applications
Removed from Consideration for Incompleteness

SUMMARY:
This item provides the Committee on School Initiatives an opportunity to review and confirm the removal of seventeenth generation open-enrollment charter school applications from consideration because of incompleteness. If an application removed from consideration by the agency because of incompleteness is determined by the committee to be complete, then the committee will direct Texas Education Agency staff to move the application forward for scoring by independent reviewers.

STATUTORY AUTHORITY: Texas Education Code (TEC), §12.101 and §12.110.

PREVIOUS BOARD ACTION: None.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: The State Board of Education (SBOE) is authorized by statute to approve the establishment of Texas open-enrollment charter schools. The Seventeenth Generation Open-Enrollment Charter Guidelines and Application, adopted by the SBOE on July 22, 2011, requires that an application be complete when received by the appropriate agency department. An application is complete if all sections of the application are included, complete, and responsive to the requirements. Sections deemed non-responsive will be considered incomplete. Any attachments without the correct document(s) will be considered incomplete.

At the May 2002 meeting, the SBOE approved review procedures for open-enrollment charter school application completeness and application compliance.

FISCAL IMPACT: None.

PUBLIC AND STUDENT BENEFIT: Open-enrollment charter schools provide avenues for local restructuring, flexibility, innovation, and choice for parents and students.

PROCEDURAL AND REPORTING IMPLICATIONS: If the Committee on School Initiatives determines that the agency has removed an application from consideration in error, the agency will notify the sponsoring entity that the application has been moved forward for scoring by external reviewers. The Committee on School Initiatives’ review and confirmation of actions taken by agency staff is not an appeals process and should not be construed as such.
