June 2012 Summary of Commissioner Rule Actions

 

1. Adopted Amendment to 19 TAC Chapter 61, School Districts, Subchapter FF, Commissioner's Rules Concerning High School Diplomas for Certain Veterans, §61.1061, Application Form for Diploma and Evidence of Eligibility

Effective Date: July 12, 2012.

Amended 19 TAC Chapter 61, School Districts, Subchapter FF, Commissioner's Rules Concerning High School Diplomas for Certain Veterans, §61.1061, Application Form for Diploma and Evidence of Eligibility, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on June 22, 2012. 

The adopted amendment implements the requirements of the Texas Education Code, §28.0251, as amended by the 82nd Texas Legislature, 2011. No changes were made to the rule or application form since published as proposed.

2. Adopted Amendments to 19 TAC Chapter 75, Curriculum, Subchapter BB, Commissioner's Rules Concerning Provisions for Career and Technical Education

Effective Date: July 12, 2012. 

Amended 19 TAC Chapter 75, Curriculum, Subchapter BB, Commissioner's Rules Concerning Provisions for Career and Technical Education, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on June 22, 2012.

The adopted amendments align language with rules concerning special education services, update the list of recognized career and technical education organizations, update provisions relating to voluntary workforce training programs, and make technical edits. No changes were made to the rules since published as proposed.

3. Adopted Amendments to 19 TAC Chapter 97, Planning and Accountability, Subchapter EE, Accreditation Status, Standards, and Sanctions

Effective Date: July 17, 2012.

Amended 19 TAC Chapter 97, Planning and Accountability, Subchapter EE, Accreditation Status, Standards, and Sanctions, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on June 27, 2012. 

The adopted amendments implement the requirements of the Texas Education Code (TEC), §39.107, Reconstitution, Repurposing, Alternative Management, and Closure, as amended by Senate Bill 738, 82nd Texas Legislature, 2011, which establishes new requirements related to the implementation of campus sanctions under the TEC, §39.107(e). The adopted amendments also establish processes by which the commissioner may defer a sanction action ordered for certain campuses that have unacceptable performance for multiple years. The amendments were adopted without changes from what was published as proposed.
