Proposed Repeal of 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter A, Elementary, §§126.1-126.3, Subchapter B, Middle School, §126.11 and §126.12, and Subchapter C, High School, §§126.21-126.29
(Second Reading and Final Adoption)
July 20, 2012
COMMITTEE ON INSTRUCTION: ACTION
STATE BOARD OF EDUCATION: ACTION
SUMMARY: This item presents for second reading and final adoption the proposed repeal of 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter A, Elementary, §§126.1-126.3, Subchapter B, Middle School, §126.11 and §126.12, and Subchapter C, High School, §§126.21-126.29. The proposed repeal would remove the Texas Essential Knowledge and Skills (TEKS), adopted effective in 1998, for Kindergarten-Grade 8 and high school technology applications courses, and related implementation language, that will be superseded by 19 TAC §§126.5-126.7, 126.13-126.16, and 126.31-126.50 of this chapter beginning with the 2012-2013 school year. No additional changes are recommended since approved for first reading.
STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.
EFFECTIVE DATE: The proposed effective date of the proposed repeal of 19 TAC §§126.1-126.3, 126.11 and 126.12, and 126.21-126.29 is August 27, 2012. Under TEC, §7.102(f), the State Board of Education (SBOE) must approve the rule action at second reading and final adoption by a vote of two-thirds of its members to specify an effective date earlier than the beginning of the 2013-2014 school year. The earlier effective date is necessary to remove from rule TEKS that will be superseded as well as to amend existing implementation language to avoid confusion.
PREVIOUS BOARD ACTION: The SBOE adopted the TEKS for technology applications effective September 1, 1998. Revisions to 19 TAC Chapter 126, Subchapters A-C, and new 19 TAC Chapter 126, Subchapter D, were adopted effective September 26, 2011, with an implementation date of the 2012-2013 school year. The proposed repeal of 19 TAC Chapter 126, §§126.1-126.3, 126.11 and 126.12, and 126.21-126.29 was approved for first reading and filing authorization at the April 2012 SBOE meeting.
BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: In April 2011, the SBOE adopted revisions to the technology applications TEKS for Kindergarten-Grade 8 and for 13 high school courses. In July 2011, the SBOE adopted revisions to the technology applications TEKS for six additional high school courses. The revised technology applications TEKS will be implemented in the 2012-2013 school year. These revisions will supersede the original TEKS at the time of implementation. With the implementation of the revised technology applications TEKS in the 2012-2013 school year, the TEKS adopted in 1998 will no longer be needed and may be repealed.
No additional changes are recommended since approved for first reading.
FISCAL IMPACT: The Texas Education Agency (TEA) has determined that there are no additional costs to persons or entities required to comply with the proposed repeal. In addition, there is no direct adverse economic impact for small businesses and microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.
PUBLIC AND STUDENT BENEFIT: Benefits include better alignment of the TEKS and coordination of the standards with the adoption of instructional materials.
PROCEDURAL AND REPORTING IMPLICATIONS: The proposed repeal would have no procedural and reporting requirements.
LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed repeal would have no locally maintained paperwork requirements.
PUBLIC COMMENTS: Following the April 2012 SBOE meeting, notice of the proposed repeal of 19 TAC §§126.1-126.3, 126.11 and 126.12, and 126.21-126.29 was filed with the Texas Register initiating the official public comment period. No comments had been received at the time this item was prepared. A summary of any public comments received regarding the proposal will be provided to the SBOE at the July 2012 meeting.
ALTERNATIVES: None.
OTHER COMMENTS AND RELATED ISSUES: To reduce the volume of the agenda and the cost of printing, the text of the proposed repeal of 19 TAC §§126.1-126.3, 126.11 and 126.12, and 126.21-126.29 is not presented in this agenda. A copy of the text will be available at the meeting. The text can also be viewed on the TEA Administrative Rules webpage at http://ritter.tea.state.tx.us/rules/tac/chapter126/index.html.
COMMISSIONER'S RECOMMENDATION: I recommend that the State Board of Education:
By an affirmative vote of two-thirds of the members of the board, approve for second reading and final adoption the proposed repeal of 19 TAC Chapter 126, Texas Essential Knowledge and Skills for Technology Applications, Subchapter A, Elementary, §§126.1-126.3, Subchapter B, Middle School, §126.11 and §126.12, and Subchapter C, High School, §§126.21-126.29, with an effective date of August 27, 2012.
