on Amendments to Open-Enrollment Charters

July 20, 2012

STATE BOARD OF EDUCATION: INFORMATION

SUMMARY:
This item lists charter school amendments that were acted upon by the commissioner of education between March 1, 2012 and May 31, 2012.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: From 1995 until September 1, 2001, amendments to and renewals of charters were acted upon by the State Board of Education. However, House Bill 6, 77th Texas Legislature, 2001, transferred these responsibilities to the commissioner of education.

FISCAL IMPACT: A fiscal impact is likely for a local school district as a result of any increased enrollment or additional grade levels served at an area charter school or the addition of campuses to an existing charter. The decrease in state revenue to a local district would occur as state funds follow students to charter schools.

PROCEDURAL AND REPORTING IMPLICATIONS: Open-enrollment charter schools are subject to the public school accountability system under the Texas Education Code, Chapter 39, Subchapters B, C, D, E, and J.
