1. Adopted New 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter CC, Commissioner's Rules Concerning Adult and Community Education, §89.1301, Service Provider Contracts for Adult Education Programs

Effective Date: September 20, 2012.

New 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter CC, Commissioner's Rules Concerning Adult and Community Education, §89.1301, Service Provider Contracts for Adult Education Programs, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on August 31, 2012.

The adopted new rule establishes a competitive procurement process for adult education service providers in accordance with the Texas Education Code, §29.2535, as added by Senate Bill 1, 82nd Texas Legislature, First Called Session, 2011. The new rule was adopted with changes from what was published as proposed.

2. Adopted Amendment to 19 TAC Chapter 97, Planning and Accountability, Subchapter AA, Accountability and Performance Monitoring, §97.1004, Adequate Yearly Progress

Effective Date: September 2, 2012.

Amended 19 TAC Chapter 97, Planning and Accountability, Subchapter AA, Accountability and Performance Monitoring, §97.1004, Adequate Yearly Progress, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on August 13, 2012.

The amendment adopts applicable excerpts, Sections II-V, of the 2012 Adequate Yearly Progress Guide. The amendment and guide were adopted without changes from what was published as proposed.

3. Adopted Amendments to 19 TAC Chapter 100, Charters, Subchapter AA, Commissioner's Rules Concerning Open-Enrollment Charter Schools

Effective Date: September 12, 2012.

Amended 19 TAC Chapter 100, Charters, Subchapter AA, Commissioner's Rules Concerning Open-Enrollment Charter Schools, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on August 23, 2012.

The adopted amendments improve the application process for charters authorized by the State Board of Education; specifically define the mitigating factors to be considered when the commissioner considers adverse action for an open-enrollment charter school; allow the commissioner the latitude to enforce sanctions other than charter revocation for student health, safety, and welfare issues; require that a charter holder notify the parents and the Texas Education Agency any time that operations are suspended at a campus or site for a period of more than three days; clarify that a charter holder that is a nonprofit entity must maintain its nonprofit status at all times; and update references to statute. The amendments were adopted with and without changes from what was published as proposed.

Effective Date: August 21, 2012.

Repealed 19 TAC Chapter 101, Assessment, Subchapter CC, Commissioner's Rules Concerning Implementation of the Academic Content Areas Testing Program, §101.3004, Performance Standards, and New 19 TAC Chapter 101, Assessment, Subchapter CC, Commissioner's Rules Concerning Implementation of the Academic Content Areas Testing Program, Division 4, Performance Standards, §101.3041, Performance Standards, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on August 1, 2012.

The adopted repeal and new rule implement performance standards for the new assessments and reflect changes to the state assessment program beginning with the implementation of the State of Texas Assessments of Academic Readiness (STAAR) in the 2011-2012 school year. The repeal and new rule were adopted without changes from what was published as proposed.

Effective Date: August 27, 2012.

Amended 19 TAC Chapter 176, Driver Training Schools, Subchapter AA, Commissioner's Rules on Minimum Standards for Operation of Licensed Texas Driver Education Schools, was filed as adopted with the Texas Register under the commissioner's rulemaking authority on August 7, 2012.

The adopted amendments implement changes to the Texas Education Code, Chapter 1001, Driver and Traffic Safety Education, by House Bill 2678, 82nd Texas Legislature, 2011. The amendments were adopted without changes from what was published as proposed.
