3. Proposed Revisions to 19 TAC Chapter 114, Texas Essential Knowledge and Skills for Languages Other Than English
(First Reading and Filing Authorization)
 

This item presents for first reading and filing authorization proposed revisions to 19 TAC Chapter 114, Texas Essential Knowledge and Skills for Languages Other Than English. The proposed revisions include amendment to Subchapter A, Elementary, §114.3, Implementation of Texas Essential Knowledge and Skills for Languages Other Than English, Elementary, Adopted 2014, and new Subchapter C, High School, §§114.47-114.52, relating to Classical Languages, Levels I-VII, and Seminar in Classical Languages. The proposed rule actions would add new Texas Essential Knowledge and Skills (TEKS) for classical languages for implementation in the 2016-2017 school year. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002 and 28.025.

4. Proclamation 2016 of the State Board of Education Advertising for Bids on Instructional Materials 

This item presents Proclamation 2016 of the State Board of Education for amendments to clarify the requirements of the proclamation. The subjects and grade levels included in Proclamation 2016 are Languages Other Than English (LOTE) and Special Topics in Social Studies to include, but not be limited to, Mexican-American Studies, African-American Studies, Native-American Studies, and Asian-American Studies. The proclamation contains the Texas Essential Knowledge and Skills (TEKS) for each subject and grade for which bids are invited, accessibility requirements for instructional materials, including specifications for providing digital files to produce Braille versions of adopted materials, and a schedule of activities. The adoption of materials submitted in response to Proclamation 2016 is scheduled for November 2015, and school districts and open-enrollment charter schools are scheduled to begin using the materials adopted under the proposed proclamation in school year 2016-2017. Statutory authority for this action is the Texas Education Code (TEC), §31.022.

5. Approval of Question and Answer Document for Proclamation 2016 

Proclamation 2016 was issued by the State Board of Education (SBOE) in April 2014. The subjects and grade levels included in Proclamation 2016 are Languages Other Than English (LOTE) and Special Topics in Social Studies to include, but not be limited to, Mexican-American Studies, African-American Studies, Native-American Studies, and Asian-American Studies. Publishers were given an opportunity to ask questions at an orientation meeting held in March 2014. Publishers and other stakeholders were encouraged to submit questions regarding the TEKS, the proclamation, and the review and adoption process. The resulting question and answer document for Proclamation 2016 is presented for board approval. Statutory authority for this action is the Texas Education Code (TEC), §28.002 and §31.022.

6. Proposed Repeal of 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter B, Adult Basic and Secondary Education
(Second Reading and Final Adoption)
 

This item presents for second reading and final adoption the proposed repeal of 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter B, Adult Basic and Secondary Education. The proposed repeal would eliminate rules that are no longer necessary as a result of statutory changes passed by the 83rd Texas Legislature, Regular Session, 2013. Authority to administer this program has been transferred to another state agency. No changes are recommended since approved for first reading. Statutory authority for this action is the Senate Bill (SB) 307, Section 2.06, 83rd Texas Legislature, Regular Session, 2013, which repealed Texas Education Code (TEC), §§7.102(c)(16), 29.253, 29.2531, 29.2535, and 29.254.

7. Proposed Revisions to 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter C, Texas Certificate of High School Equivalency
(Second Reading and Final Adoption)
 

This item presents for second reading and final adoption proposed revisions to 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter C, Texas Certificate of High School Equivalency. The proposed revisions include amendment to 19 TAC §89.45, Retesting, repeal of 19 TAC §89.46, Examinees with Disabilities, and new 19 TAC §89.46, Accommodations. The proposed revisions would update rules for alignment with the current practice for retesting and accommodations. No changes are recommended since approved for first reading. Statutory authority for this action is the Texas Education Code (TEC), §7.111, as amended by House Bill (HB) 2058 and Senate Bill (SB) 1536, 83rd Texas Legislature, Regular Session, 2013.

8. Proposed Approval of Innovative Courses 

This item recommends approval of innovative courses that do not fall within any of the subject areas of the foundation or enrichment curriculum. Statutory authority for this action is the Texas Education Code (TEC), §28.002(f).

9. Approval of Updates to Dyslexia Handbook 

This item provides an opportunity for the committee and board to review and approve the recommended updates and revisions to the Dyslexia Handbook. Statutory authority for this action is the Texas Education Code (TEC), §38.003.

COMMITTEE ON SCHOOL FINANCE/PERMANENT SCHOOL FUND

10. Per Capita Apportionment Rate for the 2013-2014 School Year 

The board is responsible for setting a per capita apportionment rate for each school year based on an estimate of the amount available for expenditures from the Available School Fund. The board adopted a preliminary 2013-2014 per capita apportionment rate of $256.125 in September 2013. Agency staff members will propose a recommended revised rate for the 2013-2014 school year at the July meeting of the Committee on School Finance/Permanent School Fund. Statutory authority for this action is the Texas Education Code (TEC), §42.004 and §43.001(b).

COMMITTEE ON SCHOOL INITIATIVES

11. Review of Proposed New 19 TAC Chapter 229, Accountability System for Educator Preparation Programs, §229.21, Transitional Provisions 

This item provides the State Board of Education (SBOE) an opportunity to review the State Board for Educator Certification (SBEC) rule action that would establish new 19 TAC Chapter 229, Accountability System for Educator Preparation Programs, §229.21, Transitional Provisions. The proposed new rule would clarify the academic years for which the current passing standard on certification examinations applies and define when individual certification fields are subject to revocation. The proposed new rule would also provide a backstop for ongoing discussion of a rewrite of 19 TAC Chapter 229, Accountability System for Educator Preparation Programs, being conducted in conjunction with the review of 19 TAC Chapter 227 and Chapter 228 required by House Bill 2012, 83rd Texas Legislature, Regular Session, 2013. The statutory authority for proposed new 19 TAC §229.21 is the Texas Education Code (TEC), §§21.045, 21.0451, and 21.0452.

12. Proposed Amendment to 19 TAC Chapter 61, School Districts, Subchapter A, Board of Trustees Relationship, §61.1, Continuing Education for School Board Members

This item presents for second reading and final adoption proposed amendment to 19 TAC Chapter 61, School Districts, Subchapter A, Board of Trustees Relationship, §61.1, Continuing Education for School Board Members. The proposed amendment, presented at the request of a State Board of Education (SBOE) member, would require coverage of specific topics during local school district orientation and continuing education and would clarify the requirements of certain trainings. No changes are recommended since approved for first reading. Statutory authority for this action is the Texas Education Code (TEC), §11.159.

13. Proposed Revisions to 19 TAC Chapter 100, Charters, Subchapter A, Open-Enrollment Charter Schools
(First Reading and Filing Authorization)
 

This item presents for first reading and filing authorization proposed revisions to 19 TAC Chapter 100, Charters, Subchapter A, Open-Enrollment Charter Schools. The proposed revisions would add new 19 TAC §100.1, Selection Process, and repeal 19 TAC §100.1, Application and Selection Procedures and Criteria; 19 TAC §100.101, Annual Report on Open-Enrollment Charter Governance; 19 TAC §100.103, Optional Open-Enrollment Charter Provisions for Contracting and Purchasing; and 19 TAC §100.105, Application to Public Senior College or University Charters and Public Junior College Charters. The proposed revisions would align State Board of Education (SBOE) rules with the Texas Education Code (TEC), Chapter 12, Subchapters D and E, as amended by Senate Bill (SB) 2, 83rd Texas Legislature, Regular Session, 2013. Statutory authority for this action is the TEC, §§7.102(c)(9), and 12.101, 12.1053, 12.110, 12.111, 12.112, 12.119, 12.152, and 12.154, as amended by SB 2, 83rd Texas Legislature, Regular Session, 2013.

14. Consideration of Gifts and/or Grants Given for the Purpose of Charter Exploration Trips 

This item provides the Committee on School Initiatives an opportunity to consider and recommend that the State Board of Education (SBOE) approve the adoption of a new board policy, Acceptance of Gifts and/or Grants for Charter School Evaluation, for the purpose of investigating charters currently operating out-of-state. Statutory authority for this action is the Texas Education Code (TEC), §7.102(c)(3).

This item outlines the rule review plan for State Board of Education (SBOE) rules during the period of September 2013 through August 2017. Texas Government Code, §2001.039, requires an ongoing four-year rule review of existing state agency rules, including SBOE rules. The rule review requirement is designed to ensure that the reason for initially adopting or readopting a rule continues to exist.

5. Review of Annual Audit Plan of the Division of Financial Compliance for 2014-2015 School Year
This item covers the annual audit plan of the Division of Financial Compliance for the 2014-2015 school year for field and independent financial reviews as specifically described in 19 TAC Chapter 109, Texas Education Agency Audit Functions, §109.21, Annual Audit Plan.

6. State Board of Education Meeting Schedule for 2015
According to the Texas Education Code, §7.106, the State Board of Education (SBOE) is to hold four meetings a year in Austin, Texas on dates determined by the chair. The SBOE may also hold other meetings as may be called by the chair. The purpose of this item is to announce SBOE meeting dates in 2015.
