Adopted State Board for Educator Certification Rules - Not Yet Effective

 

The State Board for Educator Certification (SBEC) has adopted the following rule actions, and the State Board of Education (SBOE) has reviewed them as required by statute. The agency has filed these rule actions with the Texas Register, and they have effective dates in the future.

Adopted Amendments to 19 TAC Chapter 228, Requirements for Educator Preparation Programs

Summary: The adopted amendments update the rules to reflect current law, clarify minimum standards for all educator preparation programs (EPPs), allow for flexibility, and ensure consistency among EPPs in the state. The amendments to 19 TAC §§228.1, 228.40, 228.50, and 228.60 were adopted with no changes from what was published as proposed. The amendments to 19 TAC §§228.2, 228.10, 228.20, 228.30, and 228.35 were adopted with changes.

Adopted Amendments to 19 TAC Chapter 229, Accountability System for Educator Preparation Programs, §§229.2-229.8

Summary: The adopted amendments update and make uniform definitions, modify the standards used for enforcing the reporting of data, clarify the standards used for accountability, adjust the small group exception requirements, and establish a new process for challenging sanctions imposed on programs that fail the accountability system. The amendments to 19 TAC §§229.2-229.5, 229.7, and 229.8 were adopted with changes. Section 229.6 was adopted with no changes from what was published as proposed.

Text of Adopted Amendments to 19 TAC Chapter 229 (PDF)

Adopted Amendment to 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases, Subchapter B, Enforcement Actions and Guidelines, §249.17, Decision-Making Guidelines

Summary: The adopted amendment to 19 TAC §249.17 clarifies that under the SBEC decision-making guidelines, actions that constitute "engaged in" and "solicitation" are distinct grounds for permanent revocation or denial of certification. The adopted amendment also clarifies that fact findings from final orders from other state jurisdictions may also provide the basis for initiating disciplinary proceedings in Texas. The amendment to 19 TAC §249.17, Decision-Making Guidelines, was adopted with no changes from what was published as proposed.

Adopted Amendment to 19 TAC Chapter 250, Administration, Subchapter B, Rulemaking Procedures, §250.20, Petition for Adoption of Rules or Rule Changes

Summary: The adopted amendment to 19 TAC §250.20 updates the rule to clarify the Texas Education Agency (TEA) as TEA staff. In addition, Figure: 19 TAC §250.20(a) was updated to reflect the name of the office to which the form should be mailed. The amendment to 19 TAC §250.20, Petition for Adoption of Rules or Rule Changes, was adopted with no changes from what was published as proposed.
