The U.S. Department of Education recently issued guidance related to constitutionally protected school prayer. The guidance (PDF, 41KB) requires the local education agency, as a condition of receiving funds under the No Child Left Behind Act, to certify that no policy of the LEA prevents or otherwise denies participation in constitutionally protected prayer in public elementary schools and secondary schools, as detailed in the guidance provided by the U. S. Secretary of Education.
LEAs in Texas made the required certification to TEA by submitting and certifying any application for federal funds under NCLB. This certification acknowledged acceptance of all the Special Provisions and Assurances, which includes the required provision related to constitutionally protected school prayer. Therefore, no further action is required.
