Discussion of Pending Litigation

March 26, 2009

COMMITTEE OF THE FULL BOARD: DISCUSSION
STATE BOARD OF EDUCATION: NO ACTION

SUMMARY:
The State Board of Education will enter executive session in accordance with the Texas Government Code, §551.071(1)(A), to discuss pending litigation with the general counsel, legal staff, and if necessary, attorney(s) from the Attorney General's Office as listed in the agenda. The Committee of the Full Board will meet in Room 1-103 to discuss this item.

Cases to be discussed may include:

East Waco Community Center, Inc., dba Emma L. Harrison Charter School v. Texas Education Agency and Texas State Board of Education, relating to the revocation of the school’s charter;

Heritage Academy, Inc. v. the State Board of Education et al., relating to the revocation of the school’s charter;

John G. and Marie Stella Kenedy Memorial Foundation et al. v. Dewhurst, relating to a dispute of the state’s mineral ownership in several tracts of land located in the Laguna Madre, and related litigation;

Gulf Shores Academy, Inc. v. Shirley Neeley, relating to a request for a Temporary Restraining Order and Temporary Injunction; and

any other litigation arising after the date of posting or reasonably contemplated as of the date of the board meeting.

BOARD RESPONSE: Board may advise and comment.

PREVIOUS BOARD ACTION: The committee is apprised of pending litigation at each board meeting.

FUTURE ACTION EXPECTED: Continued briefing on procedural developments.
