Maintenance of Effort (MOE) is a federal requirement that applies to all local educational agencies (LEAs) that receive federal grants under the following programs:
- Elementary and Secondary Education Act of 1965 (ESEA), as amended by the No Child Left Behind Act of 2001 (NCLB)
- Individuals with Disabilities Education Act of 2004, Part B (IDEA-B)
If your organization receives these grant funds, you are required to spend a certain amount of your state and/or local funds to pay for services that are required by these grant programs.
Each year, TEA will review your actual expenditures of state and local funds on these required services and determine if you have met all applicable MOE requirements. TEA uses information reported in the Public Education Information Management System (PEIMS) to make this determination.
