Maintenance of Effort


Maintenance of effort (MOE) is the federal requirement that each local educational agency (LEA) receiving federal funds under either the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the No Child Left Behind Act of 2001 (NCLB), or the Individuals with Disabilities Education Act of 2004, Part B (IDEA-B), spend a certain amount of its state and/or local funds on services required by the specific program under which the LEA received federal funds. Each year, the Texas Education Agency (TEA) reviews each LEA's actual expenditures of its state and local funds on these required services, as reported in the Public Education Information Management System (PEIMS), to determine if the LEA has met all applicable federal MOE requirements.
