Texas Government Code, §2001.039, established a four-year rule review cycle for all state agency rules, including State Board of Education (SBOE) rules. The rule review is designed to ensure that "the reason for adopting or readopting the rule continues to exist." This rule review plan was approved by the SBOE in January 2009. Updates to the plan were filed in November 2009 and January 2011. In accordance with statute, the plan was filed with the Texas Register in February 2009. It only includes rules currently in effect at the time the plan was adopted. Future changes to the plan will be available here. Please note that amendments to rules specified in the plan may be proposed at different dates through a separate rulemaking process.
Senate Bill 467, 77th Texas Legislature, 2001, exempted the Texas Essential Knowledge and Skills (TEKS) from the rule review requirement; accordingly, this plan does not include the rule chapters for the TEKS. Although the rules will not be reviewed as part of the rule review process, the SBOE does intend to conduct a comprehensive review of the TEKS. This comprehensive review of the curriculum content will be designed to align the adoption of textbook proclamations with the amendments to the TEKS.
