Proposed Guidelines and Application for the Residential Treatment Facility Charter Established in Human Resources Code by HB 3689

STATE BOARD OF EDUCATION: ACTION

SUMMARY:
This item provides the State Board of Education an opportunity to adopt the application for the residential treatment facility charter established in the Human Resources Code by HB 3689.

STATUTORY AUTHORITY:
Texas Education Code (TEC), §12.101.

PREVIOUS BOARD ACTION: Prior to each charter school award cycle, the SBOE has adopted a guidelines and application document establishing the contents of the application and the criteria by which charter schools would be awarded to eligible entities. The SBOE last adopted such a document on September 21, 2007.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES:
Recently, HB 3689 was passed during the 81st legislative session allowing a residential treatment facility to be awarded a charter under Human Resources Code, Subchapter C, Chapter 141.

FISCAL IMPACT: None.

PUBLIC AND STUDENT BENEFIT: Charter schools provide avenues for local restructuring, flexibility, and innovation. Significant public interest exists in the process of applying for charter schools.

PROCEDURAL AND REPORTING IMPLICATIONS:
None.

PUBLIC COMMENTS: None.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES: None.

MOTION TO BE CONSIDERED:

Adopt the Residential Treatment Facility Charter Guidelines and Application.
