Proposed Amendment to Proclamation 2010

SUMMARY:
Proclamation 2010 was issued by the State Board of Education (SBOE) in November 2007 and amended in May 2008 to add the Texas Essential Knowledge and Skills (TEKS) for English Language Arts and Reading. In September 2008 the board amended Proclamation 2010 to add the TEKS for Spanish Language Arts and Reading, Grades K-1; Spanish Reading, Grades 2-5; Spanish Literature, Grade 6; English for Speakers of Other Languages I and II; and to include college readiness standards. In July 2009, the board amended Proclamation 2010 to adjust total cost. The board also asked publishers to adjust their bid prices. Instructional materials submitted for adoption under Proclamation 2010 are scheduled for adoption in November 2009. The proposed amendment to Proclamation 2010 is to adjust total costs as necessary in response to changes in publishers’ bid prices.

STATUTORY AUTHORITY: Texas Education Code (TEC), §31.022.

PREVIOUS BOARD ACTION: Proclamation 2010 was presented to the SBOE for discussion in September 2007 and approved in November 2007. Proposed amendments to Proclamation 2010 were discussed at the March 2008 meeting and were approved in May 2008. Additional amendments were brought before the board in September 2008 to add the TEKS for Spanish Language Arts and Reading, Grades K-1; Spanish Reading, Grades 2-5; Spanish Literature, Grade 6; English for Speakers of Other Languages I and II; and to include college readiness standards. In July 2009, the board amended Proclamation 2010 to adjust total cost in response to legislative mandates. The board also asked publishers to adjust their bid prices and to submit their final bids by August 10, 2009.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: In May 2008, the SBOE approved amendments to Proclamation 2010 by removing English as a Second Language (ESL), Grades K-8, instructional materials, adding English for Speakers of Other Languages (ESOL) I and II, Grades 9-12, instructional materials, and adding teacher materials for the English Language Proficiency Standards (ELPS). The board conducted a work session in August 2009 to review publishers’ updated bid prices and to explore options for moving forward with Proclamations 2010, 2011, and 2012.

The proposed amendment would implement requests made by the 81st Texas Legislature to adjust total costs in Proclamation 2010.

FISCAL IMPACT: The estimated cost to the state for new instructional materials in each subject is based on costs established by the board and the estimated number of units that will be purchased.

PUBLIC AND STUDENT BENEFIT:
Amending the proclamation will provide additional clarification to publishers, the SBOE, and the public related to the requirements of the proclamation and events leading to the scheduled adoption in November 2009.

COMMISSIONER’S RECOMMENDATION: I recommend that the State Board of Education:

Approve the proposed amendment to Proclamation 2010 of the State Board of
Education Advertising for Bids on Instructional Materials.
